{"id":763,"date":"2010-03-29T14:47:04","date_gmt":"2010-03-29T12:47:04","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/messageries-paul-kraus-s-a-r-l-plan-social-signe"},"modified":"2023-06-01T14:38:29","modified_gmt":"2023-06-01T12:38:29","slug":"messageries-paul-kraus-s-a-r-l-plan-social-signe","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/messageries-paul-kraus-s-a-r-l-plan-social-signe\/","title":{"rendered":"Messageries Paul Kraus S.\u00e0.r.l. : Plan social sign\u00e9"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p>La soci\u00e9t\u00e9 Messageries Paul Kraus a annonc\u00e9 d\u2019une part d\u2019investir, afin d\u2019am\u00e9liorer sa comp\u00e9titivit\u00e9 en proc\u00e9dant \u00e0 une modernisation de ses structures et de ses technologies, d\u2019autre part de r\u00e9duire les co\u00fbts en envisageant des mesures de restructuration dans l\u2019ensemble des d\u00e9partements de la soci\u00e9t\u00e9 (d\u00e9partements IT, Services presse, Comptabilit\u00e9 et Finances, Secr\u00e9tariat, Logistique presse, Gestion et Entrep\u00f4t d\u2019articles de papeterie et cadeaux souvenirs). Dans l\u2019optique de r\u00e9duction des co\u00fbts, la soci\u00e9t\u00e9 MPK avait d\u00e9cid\u00e9 de proc\u00e9der au licenciement de 35 salari\u00e9s.<\/p>\n<p>La direction de la soci\u00e9t\u00e9 Messageries Paul Kraus et le syndicat OGBL sont entr\u00e9s en n\u00e9gociations le 19 mars 2010. Apr\u00e8s 6 r\u00e9unions un plan social pr\u00e9voyant des mesures d\u2019accompagnement pour les salari\u00e9s concern\u00e9s a \u00e9t\u00e9 sign\u00e9.<\/p>\n<p>Les n\u00e9gociations ont port\u00e9 en premier lieu sur les possibilit\u00e9s d\u2019\u00e9viter ou de r\u00e9duire le nombre de licenci\u00e9s. Le nombre de 35 salari\u00e9s \u00e0 licencier initialement annonc\u00e9 a pu \u00eatre r\u00e9duit \u00e0 30, suite \u00e0 des mesures de r\u00e9organisation interne.<br \/>\nL\u2019\u00e9ventuelle application du r\u00e9gime de la pr\u00e9retraite ajustement ou de la pension anticip\u00e9e, pourrait entra\u00eener par ailleurs une diminution du nombre de salari\u00e9s \u00e0 licencier de 30 \u00e0 23 personnes.<\/p>\n<p>Le plan social fixe les modalit\u00e9s de d\u00e9parts suivantes:<\/p>\n<p>Outre les indemnit\u00e9s de d\u00e9part l\u00e9gales, le d\u00e9lai de pr\u00e9avis est d\u00e9termin\u00e9 de sorte \u00e0 expirer le 31 octobre 2010 pour tous les salari\u00e9s ind\u00e9pendamment de leur anciennet\u00e9.<br \/>\nLes salari\u00e9s qui trouveront un nouvel emploi pendant leur pr\u00e9avis seront dispens\u00e9s de le prester.<\/p>\n<p>Autres indemnit\u00e9s de d\u00e9part extra-l\u00e9gales:<\/p>\n<ul>\n<li>Indemnit\u00e9 de 600 \u20ac par ann\u00e9e d\u2019anciennet\u00e9 de service compl\u00e8te<\/li>\n<li>Indemnit\u00e9 li\u00e9e \u00e0 l\u2019\u00e2ge du salari\u00e9 :<br \/>\nmoins de 30 ans : 600 \u20ac<br \/>\n+ 30 ans : 900 \u20ac<br \/>\n+ 40 ans : 1 500 \u20ac<br \/>\n+ 45 ans : 1 800 \u20ac<br \/>\n+ 50 ans : 2 100 \u20ac<br \/>\n+ 55 ans : 2 400 \u20ac<br \/>\n+ 60 ans : 2 700 \u20ac<\/li>\n<\/ul>\n<ul>\n<li>1000 \u20ac par enfant \u00e0 charge du salari\u00e9<\/li>\n<li>1000 \u20ac HTVA par salari\u00e9 licenci\u00e9 afin de financer des formations professionnelles<\/li>\n<li>un montant de 6 820 \u20ac sera distribu\u00e9 entre les salari\u00e9s qui prestent leur pr\u00e9avis jusqu\u2019au 31 octobre 2010<\/li>\n<li>Le 13e mois sera \u00ab proratis\u00e9 \u00bb et pay\u00e9 jusqu&#8217;\u00e0 la fin du contrat de chaque salari\u00e9.<\/li>\n<\/ul>\n<p>Toutes les indemnit\u00e9s de d\u00e9part extra-l\u00e9gales seront pay\u00e9es au plus tard dans les 15<br \/>\njours apr\u00e8s la fin de contrat.<\/p>\n<p>Une cellule de r\u00e9emploi est mise en place afin d\u2019aider et d\u2019assister les salari\u00e9s licenci\u00e9s dans la recherche d\u2019un nouvel emploi.<\/p>\n<p>Les salari\u00e9s seront \u00e9galement inform\u00e9s par l\u2019ADEM quant aux d\u00e9marches administratives \u00e0 effectuer dans le cadre de la rupture de leur contrat de travail et quant \u00e0 leurs droits,<br \/>\nnotamment en mati\u00e8re d\u2019aide au r\u00e9emploi et d\u2019indemnit\u00e9s de ch\u00f4mage. Les salari\u00e9s seront en outre aid\u00e9s dans la r\u00e9daction de leur curriculum vitae par le d\u00e9partement des Ressources humaines aupr\u00e8s de la soci\u00e9t\u00e9.
