{"id":707,"date":"2009-11-27T09:40:18","date_gmt":"2009-11-27T08:40:18","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/villeroy-boch-accord-a-larrachee"},"modified":"2023-06-02T13:48:57","modified_gmt":"2023-06-02T11:48:57","slug":"villeroy-boch-accord-a-larrachee","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/villeroy-boch-accord-a-larrachee\/","title":{"rendered":"Villeroy &#038; Boch : Accord \u00e0 l\u2019arrach\u00e9e"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p>Apr\u00e8s 14 heures de n\u00e9gociation quasi ininterrompues \u00e0 l\u2019Office national de conciliation, les partenaires sociaux ont enfin trouv\u00e9 un accord sur les modalit\u00e9s du plan social de Villeroy &amp; Boch.<\/p>\n<p>Initialement il s\u2019agissait de 230 personnes qui auraient d\u00fb faire partie du plan social.<br \/>\nAujourd\u2019hui les chiffres se calculent comme suit: 2 personnes ont d\u00e9missionn\u00e9 sans indemnit\u00e9s, 10 postes ont \u00e9t\u00e9 cr\u00e9\u00e9s, 3 personnes font partie d\u2019un reclassement externe ou sont en invalidit\u00e9, 15 personnes ont b\u00e9n\u00e9fici\u00e9 d\u2019un d\u00e9part volontaire et 11 personnes b\u00e9n\u00e9ficient d\u2019une pr\u00e9retraite. Ceci am\u00e8ne le nombre des personnes \u00e0 licencier \u00e0 188 personnes.<br \/>\nLes salari\u00e9s concern\u00e9s par le pr\u00e9sent plan social seront licenci\u00e9s avec effet au 15 janvier 2010. Leur pr\u00e9avis doit \u00eatre prest\u00e9.<br \/>\nL&#8217;indemnit\u00e9 extral\u00e9gale par salari\u00e9 est de 100! par mois d\u2019anciennet\u00e9. Les personnes ayant trouv\u00e9 un travail pourront avec accord de la direction partir d\u00e8s la signature du nouveau contrat. Cependant pendant le pr\u00e9avis allant de janvier 2010 \u00e0 fin mars 2010 ils toucheront uniquement le compl\u00e9ment de salaire pr\u00e9vu par le Code du travail. A partir du 1er avril et jusqu\u2019\u00e0 la fin du pr\u00e9avis, ils toucheront la totalit\u00e9 du salaire mensuel.<\/p>\n<p>Les personnes en invalidit\u00e9 touchent une somme forfaitaire de 15 000\u20ac.<br \/>\nLes personnes ayant b\u00e9n\u00e9fici\u00e9 d\u2019un d\u00e9part volontaire toucheront 50\u20ac par mois d\u2019anciennet\u00e9. Cette indemnit\u00e9 prend en compte le pr\u00e9avis que ces personnes n\u2019ont pas prest\u00e9 mais qui leur a \u00e9t\u00e9 pay\u00e9 dans sa totalit\u00e9.<\/p>\n<p>Pour les ann\u00e9es 2010 et 2011, toutes les personnes non reprises ci avant et qui seront \u00e9ligibles pour toucher la pr\u00e9retraite ou la retraite anticip\u00e9e, ne seront pas licenci\u00e9es mais elles resteront sous contrat V &amp; B jusqu\u2019\u00e0 la date d\u2019obtention de la pr\u00e9retraite ou de la retraite anticip\u00e9e.<\/p>\n<p>Il y a cependant une clause dans le plan social qui ne plait pas du tout aux repr\u00e9sentants syndicaux, cependant c\u2019\u00e9tait une condition sine qua non pour obtenir un r\u00e9sultat. Cette clause dit que chaque salari\u00e9 qui tombe malade entre le 1er d\u00e9cembre 2009 et le 31 mars 2010 se verra d\u00e9duire de son indemnit\u00e9 extral\u00e9gale la somme de 100\u20ac par jour de maladie avec un maximum de 4000\u20ac pour les 4 mois. Une commission paritaire compos\u00e9e de repr\u00e9sentants de la direction de V &amp; B et de la d\u00e9l\u00e9gation statuera sur tous les cas et notamment sur les cas de longue maladie, de maladie grave ou d\u2019hospitalisations.
