{"id":671,"date":"2009-07-14T14:07:44","date_gmt":"2009-07-14T12:07:44","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/accord-signe-3"},"modified":"2023-05-26T13:19:40","modified_gmt":"2023-05-26T11:19:40","slug":"accord-signe-3","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/accord-signe-3\/","title":{"rendered":"Accord sign\u00e9"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p>Suite \u00e0 la d\u00e9cision de la soci\u00e9t\u00e9 Qatena de fermer son imprimerie de Leudelange et par cons\u00e9quent de licencier l\u2019ensemble du personnel, les partenaires sociaux ont pu trouver un accord concernant le plan social pr\u00e9voyant les mesures d\u2019accompagnements pour les salari\u00e9s licenci\u00e9s.<\/p>\n<p>La direction de Qatena et le syndicat OGBL sont entr\u00e9es en n\u00e9gociation le 29 juin dernier, n\u00e9gociations qui se sont achev\u00e9es le 13 juillet en fin d\u2019apr\u00e8s-midi. Ces n\u00e9gociations ont eu du mal \u00e0 \u00e9voluer, du fait que la direction de la soci\u00e9t\u00e9 n\u2019\u00e9tait pas pr\u00eate \u00e0 faire des concessions concernant les indemnit\u00e9s de d\u00e9parts extral\u00e9gales. Il a fallu 4 r\u00e9unions de n\u00e9gociations pour aboutir \u00e0 un r\u00e9sultat ce lundi 13 juillet.<\/p>\n<p>Le r\u00e9sultat qui a \u00e9t\u00e9 sign\u00e9 hier entre partenaires sociaux est le suivant :<\/p>\n<p>Dans la premi\u00e8re partie des n\u00e9gociations, les efforts ont \u00e9t\u00e9 concentr\u00e9s surtout sur l\u2019\u00e9l\u00e9ment &#8220;maintien dans l\u2019emploi&#8221;. Un premier r\u00e9sultat a pu \u00eatre obtenu:<\/p>\n<ul>\n<li>11 salari\u00e9s seront reclass\u00e9s \u00e0 la soci\u00e9t\u00e9 Imprimerie de la Cour Victor Buck.<\/li>\n<li>2 salari\u00e9es (actuellement enceintes) seront \u00e9galement reprises par la soci\u00e9t\u00e9 Imprimerie de la Cour Victor Buck (pour une dur\u00e9e d\u00e9termin\u00e9e), ceci afin de leur permettre de prendre leur cong\u00e9 parental.<\/li>\n<li>Une salari\u00e9e a sign\u00e9 une r\u00e9siliation d\u2019un commun accord avec effet au 30 juin 2009.<\/li>\n<\/ul>\n<p>Pour les 73 salari\u00e9s qui n\u2019ont malheureusement pas pu profiter des mesures de maintien dans l\u2019emploi, un plan social a \u00e9t\u00e9 n\u00e9goci\u00e9 qui fixe les modalit\u00e9s de d\u00e9parts suivantes:<\/p>\n<ul>\n<li>En plus des indemnit\u00e9s p\u00e9cuniaires de d\u00e9parts l\u00e9gales, un pr\u00e9avis l\u00e9gal de 90 jours a pu \u00eatre n\u00e9goci\u00e9 pour les salari\u00e9s ayant moins de 5 ans d\u2019anciennet\u00e9 et l\u2019ensemble du personnel concern\u00e9 est dispens\u00e9 de prester leur pr\u00e9avis. Cette dispense de prestation de pr\u00e9avis devra permettre aux salari\u00e9s licenci\u00e9s de se consacrer \u00e0 la recherche d\u2019un nouvel emploi.<\/li>\n<\/ul>\n<p>Les salari\u00e9s qui trouveront un nouvel emploi pendant leur pr\u00e9avis auront droit \u00e0 50% de leur indemnit\u00e9 de pr\u00e9avis l\u00e9gale ainsi qu\u2019\u00e0 75% de l\u2019indemnit\u00e9 extral\u00e9gale. L\u2019indemnit\u00e9 extral\u00e9gale est l\u2019\u00e9quivalent des mois de pr\u00e9avis r\u00e9mun\u00e9r\u00e9s \u00e0 2 000 \u20ac pour les 3 premiers mois de pr\u00e9avis, \u00e0 1900 Euros pour le 4e mois de pr\u00e9avis et \u00e0 1800 Euros pour le 5e et 6e mois de pr\u00e9avis. Cette mesure tient compte d\u2019un certain \u00e9quilibre entre les salari\u00e9s avec une faible anciennet\u00e9 et ceux avec une anciennet\u00e9 plus importante.<\/p>\n<ul>\n<li>Il a \u00e9t\u00e9 retenu que la prime, le p\u00e9cule et le 13e mois seraient &#8220;proratis\u00e9s&#8221; et pay\u00e9s jusqu\u2019\u00e0 la fin de contrat de chaque salari\u00e9. Toutes les indemnit\u00e9s de d\u00e9parts extral\u00e9gales seront pay\u00e9es au plus tard dans les 15 jours apr\u00e8s la fin de contrat.<\/li>\n<\/ul>\n<p>Il a aussi \u00e9t\u00e9 d\u00e9cid\u00e9 que la cellule de r\u00e9emploi qui a \u00e9t\u00e9 mise en place par la direction, restera en place afin d\u2019aider et d\u2019assister les salari\u00e9s licenci\u00e9s dans la recherche d\u2019un nouvel emploi.<\/p>\n<p>Des r\u00e9unions d\u2019information avec un repr\u00e9sentant de l\u2019ADEM ont eu lieu pour renseigner le personnel concernant l\u2019octroi des indemnit\u00e9s de ch\u00f4mage et surtout de donner les informations concernant les mesures d\u2019accompagnement de la part du fonds de l\u2019emploi dans le contexte de la recherche et de la reprise d\u2019un nouvel emploi.<\/p>\n<p><strong>Communiqu\u00e9 par le Syndicat Imprimeries, M\u00e9dias et Culture \u2013FLTL de<\/strong><br \/>\n<strong>l\u2019OGBL<\/strong><br \/>\n<strong>le 14 juillet 2009<\/strong><\/p>","protected":false},"author":1,"featured_media":0,"template":"","categorie_communiques":[50],"syndicat":[76],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
