{"id":608,"date":"2009-02-16T10:40:12","date_gmt":"2009-02-16T09:40:12","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/plan-social-chez-ludec-s-a-r-l-rotarex-distribution-s-a"},"modified":"2023-06-02T11:49:06","modified_gmt":"2023-06-02T09:49:06","slug":"plan-social-chez-ludec-s-a-r-l-rotarex-distribution-s-a","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/plan-social-chez-ludec-s-a-r-l-rotarex-distribution-s-a\/","title":{"rendered":"Plan social chez LUDEC s.\u00e0 r.l.\/Rotarex Distribution S.A."},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p>Le vendredi 13 f\u00e9vrier 2009, un accord relatif au plan social de la firme LUDEC s.\u00e0 r.l et ROTAREX Distribution a pu \u00eatre trouv\u00e9 pour le site de Holzem.<\/p>\n<p>Comme la production a baiss\u00e9 d\u2019environ 50%, et \u00e9tant donn\u00e9 que la direction consid\u00e8re qu\u2019il s\u2019agit l\u00e0 d\u2019une \u00e9volution \u00e0 long terme, voire d\u00e9finitive m\u00eame, tous les salari\u00e9s concern\u00e9s ont \u00e9t\u00e9 lib\u00e9r\u00e9s avec effet imm\u00e9diat \u00e0 partir du premier jour et pour toute la dur\u00e9e des n\u00e9gociations du plan social.<\/p>\n<p>Dans le cadre d\u2019une r\u00e9union du personnel avec des repr\u00e9sentants de l\u2019ADEM, les salari\u00e9s concern\u00e9s ont \u00e9t\u00e9 inform\u00e9s sur les raisons de ce plan social et sur les d\u00e9marches \u00e0 entreprendre.<\/p>\n<p>Apr\u00e8s la r\u00e9union du personnel, un entretien personnalis\u00e9 a eu lieu avec chaque salari\u00e9. Lors de chacune de ces entrevues, le secr\u00e9taire central de l\u2019OGBL ainsi que la d\u00e9l\u00e9gation du personnel furent pr\u00e9sents.<\/p>\n<p>Apr\u00e8s la signature du plan social, les salari\u00e9s concern\u00e9s seront inform\u00e9s encore une fois individuellement de leur licenciement.<\/p>\n<p>1 salari\u00e9 a \u00e9t\u00e9 except\u00e9 du plan social par la direction de l\u2019entreprise; \u00e0 2 salari\u00e9s la possibilit\u00e9 d\u2019un nouvel emploi aupr\u00e8s de la firme Rotarex Group \u00e0 Lintgen a \u00e9t\u00e9 offerte.<\/p>\n<p>Pour les salari\u00e9s qualifi\u00e9s, il y de fortes chances de pouvoir les int\u00e9grer rapidement dans d\u2019autres entreprises.<\/p>\n<p>Apr\u00e8s des n\u00e9gociations tr\u00e8s dures qui devaient \u00eatre cl\u00f4tur\u00e9es end\u00e9ans la p\u00e9riode de 14 jours fix\u00e9e par la loi, le nombre de salari\u00e9s concern\u00e9s \u00e0 ce stade par le plan social a pu \u00eatre r\u00e9duit de 30 \u00e0 \u201eseulement\u201c 29 personnes.<\/p>\n<p>Il reste \u00e0 relever cependant que 13 salari\u00e9s ont une anciennet\u00e9 de service de moins de 5 ans et n\u2019ont donc l\u00e9galement pas droit \u00e0 des indemnit\u00e9s.<\/p>\n<p>Outre les indemnit\u00e9s l\u00e9gales, les indemnit\u00e9s suivantes ont \u00e9t\u00e9 n\u00e9goci\u00e9es:<\/p>\n<ul>\n<li>3000 \u20ac\/enfant pour le salari\u00e9 qui peut fournir un certificat d\u2019allocations familiales;<\/li>\n<li>250 \u20ac\/ann\u00e9e d\u2019anciennet\u00e9 de service;<\/li>\n<li>pour chaque salari\u00e9 une indemnit\u00e9 \u201esociale\u201c pour laquelle des crit\u00e8res comme enfants \u00e0 charge, \u00e9tat civil, anciennet\u00e9 de service, \u00e2ge ont \u00e9t\u00e9 pris en consid\u00e9ration. Ce montant a \u00e9t\u00e9 n\u00e9goci\u00e9 globalement et la cl\u00e9 de r\u00e9partition a \u00e9t\u00e9 fix\u00e9e par la d\u00e9l\u00e9gation du personnel.<\/li>\n<\/ul>\n<p><strong>Communiqu\u00e9 par le Syndicat Transformation sur M\u00e9taux et Garages<\/strong><br \/>\n<strong>le 16 f\u00e9vrier 2009<\/strong><\/p>","protected":false},"author":1,"featured_media":0,"template":"","categorie_communiques":[162],"syndicat":[165],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
