<\/p>

Inlassablement, le gouvernement \u00e9tend son attaque contre le mod\u00e8le luxembourgeois de dialogue social et donc contre les acquis sociaux obtenus de haute lutte au cours des derni\u00e8res d\u00e9cennies. Cela ne se limite pas du tout au secteur priv\u00e9 et au litige non r\u00e9solu depuis octobre 2024 sur les conventions collectives. Dans le secteur public \u00e9galement, le dialogue social est attaqu\u00e9.<\/p>\n

Loin de l\u2018opinion publique, le gouvernement nie d\u00e9sormais aux syndicats sectoriels de fonctionnaires et d\u2018employ\u00e9s du secteur public le droit \u00e0 la libert\u00e9 syndicale.<\/p><\/blockquote>\n

Dans le cadre d\u2018une proc\u00e9dure pendante devant la Cour administrative, le gouvernement affirme que les syndicats reconnus comme repr\u00e9sentation du personnel par arr\u00eat\u00e9 minist\u00e9riel n\u2018ont pas le droit de s\u2018exprimer publiquement en cas de litige. Ceux-ci n\u2018auraient pas le droit d\u2018\u00e9mettre des avis sur des projets de loi, de s\u2018exprimer sur des questions de politique g\u00e9n\u00e9rale, m\u00eame si celles-ci concernent directement leurs membres. Il est remis en question que ces syndicats reconnus comme repr\u00e9sentation du personnel puissent soumettre des litiges \u00e0 la commission de conciliation de la fonction publique.<\/p>\n

De mani\u00e8re g\u00e9n\u00e9rale, le gouvernement souligne que les repr\u00e9sentations du personnel n\u2018ont pas vocation \u00e0 faire du syndicalisme. Elles sont r\u00e9duites \u00e0 une fonction purement consultative vis-\u00e0-vis de la direction de l\u2018administration concern\u00e9e.<\/p>\n

Il s\u2018agit l\u00e0 d\u2018une rupture totale avec la pratique des derni\u00e8res d\u00e9cennies.<\/p>\n

L\u2018OGBL, qui a conclu des accords de coop\u00e9ration avec plusieurs associations de la Fonction publique, s\u2018oppose r\u00e9solument \u00e0 cette attaque effront\u00e9e du gouvernement contre les droits fondamentaux g\u00e9n\u00e9raux, qui sont par ailleurs inscrits dans la Constitution et dans des conventions internationales de l\u2018Organisation internationale du travail qui lient le Luxembourg.
\nPour cette raison, l\u2018OGBL a adress\u00e9 une demande d\u2018aide urgente \u00e0 l\u2018Organisation internationale du travail.<\/p>\n
