{"id":457,"date":"2008-01-11T13:36:14","date_gmt":"2008-01-11T12:36:14","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/negociation-dun-plan-social-chez-fulflex-sa-a-kehlen-piquet-de-protestation-des-salaries-concernes"},"modified":"2023-06-02T13:54:53","modified_gmt":"2023-06-02T11:54:53","slug":"negociation-dun-plan-social-chez-fulflex-sa-a-kehlen-piquet-de-protestation-des-salaries-concernes","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/negociation-dun-plan-social-chez-fulflex-sa-a-kehlen-piquet-de-protestation-des-salaries-concernes\/","title":{"rendered":"Piquet de protestation des salari\u00e9s concern\u00e9s"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p>Le 18 juillet 2007, la direction de Fulflex avait inform\u00e9 la d\u00e9l\u00e9gation du personnel du site luxembourgeois ainsi que les syndicats OGBL et LCGB de sa d\u00e9cision de se s\u00e9parer de 20 personnes en raison de la d\u00e9localisation de la production vers Singapore.<br \/>\nLors de la r\u00e9union suivante, le 27 juillet 2007, la m\u00eame direction revenait sur ses propos en informant les syndicats que seulement 10 personnes seraient concern\u00e9es et qu\u2019une partie importante de la production resterait au Luxembourg. C\u2019est \u00e0 ce moment-l\u00e0 que les syndicats ont n\u00e9goci\u00e9 un plan de maintien dans l\u2019emploi : 5 personnes ont \u00e9t\u00e9 reclass\u00e9es dans une autre soci\u00e9t\u00e9 et 5 personnes ont opt\u00e9 pour un d\u00e9part volontaire avec une indemnit\u00e9 n\u00e9goci\u00e9e entre partenaires sociaux. Cet accord a \u00e9t\u00e9 sign\u00e9 en date du 31 octobre 2007 et la direction nous rassurait sur l\u2019avenir du site.<br \/>\nOr, ce calme \u00e9tait \u00e9ph\u00e9m\u00e8re, car d\u00e9j\u00e0 le 6 d\u00e9cembre 2007, la direction informait la d\u00e9l\u00e9gation du personnel et les syndicats OGBL et LCGB que son client principal aurait d\u00e9cid\u00e9 du jour au lendemain de changer de produit et que de ce fait Fulflex Luxembourg perdrait 80% de sa production. Ce revirement aurait comme cons\u00e9quence le licenciement collectif de 18 personnes sur un total de 26 personnes restantes.<br \/>\nAinsi, le 8 janvier 2008, les n\u00e9gociations pour la mise en place d\u2019un plan social ont commenc\u00e9.<br \/>\nLors de la deuxi\u00e8me r\u00e9union de n\u00e9gociation, la direction a propos\u00e9 ce qui suit :<\/p>\n<ul>\n<li>un pr\u00e9avis de 90 jours (au lieu des 75 jours l\u00e9gaux) pour les personnes ayant moins de 5 ans d\u2019anciennet\u00e9 ;<\/li>\n<li>le paiement du solde des cong\u00e9s et la dispense imm\u00e9diate ;<\/li>\n<li>le paiement de 50% des primes ;<\/li>\n<li>le paiement d\u2019un mois de salaire compl\u00e9mentaire pour les personnes ayant une anciennet\u00e9 de plus de 5 ans ainsi<\/li>\n<li>qu&#8217;une indemnit\u00e9 de 800 \u20ac par ann\u00e9e d\u2019anciennet\u00e9.<\/li>\n<\/ul>\n<p>La direction d\u00e9clarait vouloir payer l\u2019int\u00e9gralit\u00e9 de l\u2019indemnit\u00e9 en une fois en pr\u00e9tendant qu\u2019en touchant une somme aussi importante les salari\u00e9s seraient contents.<br \/>\nLes syndicats OGBL et LCGB sont choqu\u00e9s par cette attitude m\u00e9prisante des salari\u00e9s et l\u2019id\u00e9e machiav\u00e9lique de faire croire aux salari\u00e9s que le paiement en une fois repr\u00e9sentait \u00ab un cadeau \u00bb. En effet, ni le montant de l\u2019indemnit\u00e9 suppl\u00e9mentaire par ann\u00e9e d\u2019anciennet\u00e9, ni le paiement unique pr\u00e9judiciable aux salari\u00e9s, n\u2019est acceptable aux yeux des syndicats.<br \/>\nLe personnel a compris le jeu de la direction et s\u2019est manifest\u00e9 unanimement pour la reconnaissance de son anciennet\u00e9 par le biais du paiement d\u2019une indemnit\u00e9 de 2600 \u20ac par ann\u00e9e d\u2019anciennet\u00e9. Il faut savoir que l\u2019anciennet\u00e9 moyenne dans la soci\u00e9t\u00e9 est de moins de 7 ans.<br \/>\nLe lundi, 14 janvier 2008, la 3e r\u00e9union de n\u00e9gociation est pr\u00e9vue \u00e0 9h30 avec la direction.<br \/>\nNous esp\u00e9rons que la direction locale prend enfin ses responsabilit\u00e9s et nous fait une proposition respectueuse des attentes justifi\u00e9es du personnel. Les salari\u00e9s sont d\u00e9cid\u00e9s de ne pas se laisser faire et une manifestation sera organis\u00e9e devant l\u2019usine avec un point presse \u00e0 13h50.<\/p>\n<p><strong>Communiqu\u00e9 le 11 janvier 2008<\/strong><br \/>\n<strong>par le syndicat Bois, Caoutchouc, C\u00e9ramique, Chimie.<br \/>\nCiment, Papier, Plastique,<\/strong> <strong>Textiles et Verre de l\u2019OGBL et le LCGB<\/strong><\/p>","protected":false},"author":1,"featured_media":0,"template":"","categorie_communiques":[162],"syndicat":[165],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
