Le licenciement collectif pr\u00e9vu, qui concerne principalement des salari\u00e9s hautement qualifi\u00e9s, met \u00e0 nu une incoh\u00e9rence fondamentale: alors que les repr\u00e9sentants des salari\u00e9s ne cessent de d\u00e9plorer une p\u00e9nurie de main-d\u2018\u0153uvre qualifi\u00e9e, ce sont justement des collaborateurs bien form\u00e9s qui sont pouss\u00e9s vers le ch\u00f4mage. Cette situation est un paradoxe dramatique.<\/p>\n<p>AlivePlus g\u00e8re \u00e0 la fois un service de soins \u00e0 domicile et un centre de jour pour enfants ayant des besoins sp\u00e9cifiques et des troubles du comportement. L\u2018ASBL est donc active dans un secteur enti\u00e8rement financ\u00e9 par des fonds publics. Du point de vue de l\u2018OGBL et du LCGB, il ne devrait donc pas y avoir de licenciements pour raisons \u00e9conomiques.<\/p>\n<p>Les difficult\u00e9s financi\u00e8res dont se plaint AlivePlus r\u00e9sultent d\u2018un nombre de salari\u00e9s disproportionn\u00e9 par rapport aux activit\u00e9s r\u00e9elles. En m\u00eame temps, des postes ont \u00e9t\u00e9 cr\u00e9\u00e9s sans contrepartie financi\u00e8re.<\/p>\n<p>Apr\u00e8s l\u2018annonce d\u2018AlivePlus de vouloir supprimer des postes de travail, l\u2018OGBL a r\u00e9agi de mani\u00e8re proactive et a exig\u00e9 une r\u00e9union d\u2018urgence aupr\u00e8s de la Conf\u00e9d\u00e9ration des prestataires de soins (COPAS) afin d\u2018inciter les employeurs \u00e0 prendre leurs responsabilit\u00e9s. Le plan initial de la direction, qui pr\u00e9voyait le licenciement imm\u00e9diat et sans indemnit\u00e9s de 19 salari\u00e9s non finan\u00e7ables, a \u00e9t\u00e9 r\u00e9duit, gr\u00e2ce \u00e0 l\u2018intervention des syndicats, d\u2018abord \u00e0 douze, puis \u00e0 neuf personnes au maximum \u2013 ainsi, l\u2018intervention des syndicats a permis d\u2018amortir le licenciement collectif et d\u2018\u00e9viter le pire.<\/p>\n<p>Entre-temps, l\u2018OGBL a \u00e9galement pris contact avec d\u2018autres prestataires de services du secteur social afin de permettre aux sept salari\u00e9s concern\u00e9s une transition en douceur vers de nouveaux emplois \u00e9quivalents.<br \/>\nEn plus de ces mesures, les syndicats et les repr\u00e9sentants du personnel ont n\u00e9goci\u00e9 une compensation financi\u00e8re pour les salari\u00e9s concern\u00e9s afin d\u2018att\u00e9nuer l\u2018impact des licenciements involontaires. Outre les normes minimales fix\u00e9es par le Code du travail, chaque salari\u00e9 recevra ainsi une indemnit\u00e9 de d\u00e9part \u00e9quivalente \u00e0 trois mois de salaire suppl\u00e9mentaires. Les salari\u00e9s qui se trouvent dans les cat\u00e9gories inf\u00e9rieures pourront en outre b\u00e9n\u00e9ficier d\u2018un budget de formation de 1000 euros par personne. En outre, l\u2018OGBL, le LCGB et la d\u00e9l\u00e9gation du personnel ont pu obtenir que les salari\u00e9s concern\u00e9s soient lib\u00e9r\u00e9s imm\u00e9diatement et avec l\u2018int\u00e9gralit\u00e9 de leur salaire pendant la p\u00e9riode de licenciement, afin qu\u2018ils puissent r\u00e9int\u00e9grer le march\u00e9 du travail sans d\u00e9lai.<\/p>\n<p>Bien que l\u2018OGBL et le LCGB aient r\u00e9ussi \u00e0 amortir socialement les effets n\u00e9gatifs du licenciement collectif, il doit \u00eatre clair qu\u2018un pays comme le Luxembourg ne peut pas se permettre de mettre \u00e0 la rue des professionnels du secteur de la sant\u00e9 et du social.
