En effet, suite \u00e0 l\u2019internalisation des services de s\u00e9curit\u00e9 du Parlement europ\u00e9en \u00e0 partir du 1<sup>er<\/sup> janvier 2022, Seris Security risque de se retrouver en sureffectif.<\/p>\n<p>M\u00eame si la direction de Seris a d\u00e9j\u00e0 pu prendre les devants et a ainsi essay\u00e9 de contrecarrer au mieux les cons\u00e9quences de cette internalisation, les partenaires sociaux sont tous d\u2019avis qu\u2019il est n\u00e9cessaire de r\u00e9aliser un plan de maintien dans l\u2019emploi. Ceci permettra effectivement de pouvoir recourir \u00e0 l\u2019ensemble des moyens l\u00e9gaux disponibles (tels que les formations, le travail \u00e0 temps partiel, le pr\u00eat de main-d\u2019\u0153uvre, les am\u00e9nagements des heures de travail, etc.) et favorisera une recherche active de solutions au niveau sectoriel. Toutes ces options doivent \u00eatre pleinement utilis\u00e9es avant de parler de licenciements secs.<\/p>\n<p>Au cours de cette premi\u00e8re r\u00e9union, qui s\u2019est d\u00e9roul\u00e9e dans un climat tr\u00e8s constructif, une s\u00e9rie de mesures a donc pu \u00eatre retenue afin d\u2019\u00e9viter de recourir \u00e0 des licenciements avec un accent particulier mis sur les efforts de formation en vue d\u2019une reconversion interne ou externe des salari\u00e9s concern\u00e9s.<\/p>\n<p>Alors que la loi sur les transferts d\u2019entreprise est g\u00e9n\u00e9ralement la r\u00e8gle en cas de perte d\u2019un contrat \u2014 ce qui est d\u2019ailleurs tr\u00e8s courant dans le secteur de la s\u00e9curit\u00e9 priv\u00e9e \u2014 celle-ci n\u2019est pas appliqu\u00e9e en cas d\u2019internalisation d\u2019un service. En d\u2019autres termes, les agents affect\u00e9s jusqu\u2019\u00e0 pr\u00e9sent au site du Parlement europ\u00e9en \u00e0 Luxembourg ont d\u00fb passer le concours interne du Parlement europ\u00e9en s\u2019ils souhaitaient garder leur poste, chose qui \u00e9tait pour le moins controvers\u00e9e.<\/p>\n<p>Pour rappel, les institutions europ\u00e9ennes au Luxembourg ont cr\u00e9\u00e9 la pol\u00e9mique ces derni\u00e8res ann\u00e9es car elles n\u2019ont pas respect\u00e9 les salaires sociaux minimums luxembourgeois. Cela a par exemple \u00e9t\u00e9 le cas l\u2019ann\u00e9e pass\u00e9e lorsque les agents impact\u00e9s ont d\u00fb prendre la d\u00e9cision de participer au concours organis\u00e9 par le Parlement europ\u00e9en pour ne pas risquer un \u00e9ventuel licenciement au cas o\u00f9 aucune solution n\u2019aurait pu \u00eatre trouv\u00e9e.<\/p>\n<p>Tandis que le Parlement europ\u00e9en a entre-temps align\u00e9 les salaires de base sur les salaires minimaux luxembourgeois, il ne faut pas oublier qu\u2019une majorit\u00e9 d\u2019agents de s\u00e9curit\u00e9 priv\u00e9e b\u00e9n\u00e9ficient d\u2019un salaire de base sup\u00e9rieur au salaire social minimum qualifi\u00e9 en raison de la grille de salaire de la convention collective sectorielle. L\u2019OGBL et le LCGB insistent ainsi pour que toutes les institutions europ\u00e9ennes bas\u00e9es dans le pays respectent et prennent en consid\u00e9ration les dispositions l\u00e9gales et conventionnelles luxembourgeoises.<\/p>\n<p>Rappelons en effet qu&#8217;il y a un an, les agents de s\u00e9curit\u00e9 \u00e9taient consid\u00e9r\u00e9s comme indispensables au Luxembourg et \u00e9taient en premi\u00e8re ligne dans la lutte contre la pand\u00e9mie de Covid-19.
