{"id":2815,"date":"2021-05-05T15:05:39","date_gmt":"2021-05-05T13:05:39","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/droit-a-la-deconnexion"},"modified":"2023-06-22T09:40:02","modified_gmt":"2023-06-22T07:40:02","slug":"droit-a-la-deconnexion","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/droit-a-la-deconnexion\/","title":{"rendered":"Droit \u00e0 la d\u00e9connexion"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p>En date du 30 avril 2021, le Conseil \u00e9conomique et social a adopt\u00e9 \u00e0 l\u2019unanimit\u00e9 un avis sur la question de la d\u00e9connexion. Les repr\u00e9sentants des entreprises et des syndicats ont trouv\u00e9, dans le cadre d\u2019un avis, un accord sur le principe d\u2019introduire un nouveau chapitre relatif au \u00ab respect du droit \u00e0 la d\u00e9connexion \u00bb au Code du travail luxembourgeois.<\/p>\n<p>Il s\u2019agit d\u2019un grand pas en avant pour s\u2019assurer que les salari\u00e9s puissent profiter pleinement de leur temps libre, sans devoir \u00eatre en attente de mails ou d\u2019appels de leur employeur \u00e0 toute heure. En effet, la joignabilit\u00e9 permanente, coupl\u00e9e avec l\u2019effacement des fronti\u00e8res entre temps de travail et vie priv\u00e9e, est un ph\u00e9nom\u00e8ne qui ne cesse de s\u2019amplifier. Le recours massif au t\u00e9l\u00e9travail en raison de la pand\u00e9mie de la Covid-19 a encore aggrav\u00e9 la situation. Mais il ne s\u2019agit pas d\u2019un ph\u00e9nom\u00e8ne limit\u00e9 aux t\u00e9l\u00e9travailleurs.<\/p>\n<p><strong>Le respect du droit \u00e0 la d\u00e9connexion devient une obligation de l\u2019employeur<\/strong><\/p>\n<p>Si on parle de droit \u00e0 la d\u00e9connexion, il faut tout de m\u00eame souligner que l\u2019employeur n\u2019a pas a priori pas de droit de demander des prestations des salari\u00e9s en dehors des heures de travail contractuelles !<\/p>\n<p>L\u2019accord r\u00e9cemment propos\u00e9 va dans ce sens. Il pr\u00e9voit l\u2019obligation pour tout employeur du pays dont les salari\u00e9s utilisent des outils num\u00e9riques pour des fins professionnelles d\u2019instaurer un r\u00e9gime pour assurer le respect du droit \u00e0 la d\u00e9connexion du salari\u00e9. Ce r\u00e9gime d\u00e9finit les modalit\u00e9s pratiques de d\u00e9connexion des outils num\u00e9riques, des mesures de sensibilisation et de formation et des modalit\u00e9s de compensation pour les salari\u00e9s dans le cas o\u00f9 la nature du travail rend impossible la d\u00e9connexion (syst\u00e8me d\u2019astreinte).<br \/>\nCe point devient un point obligatoire \u00e0 n\u00e9gocier dans le cadre de la convention collective de travail (CCT), partout o\u00f9 il en existe.<\/p>\n<p>En l\u2019absence d\u2019une CCT, les r\u00e8gles du dialogue social en entreprise s\u2019appliquent :<br \/>\n&#8211; cod\u00e9cision entre l\u2019employeur et la d\u00e9l\u00e9gation du personnel \u00e0 partir de 150 salari\u00e9s ;<br \/>\n&#8211; information et consultation de la d\u00e9l\u00e9gation entre 15 et 149 salari\u00e9s ;<br \/>\n&#8211; dans les entreprises avec moins de 15 salari\u00e9s, une simple information au personnel, mais c\u2019est n\u00e9anmoins une obligation de l\u2019employeur de mettre en place un tel r\u00e9gime.<\/p>\n<p><strong>Une obligation assortie de sanctions<\/strong><\/p>\n<p>Si un employeur refuse de mettre en place un r\u00e9gime assurant le respect du droit \u00e0 la d\u00e9connexion, il peut se voir imposer des amendes administratives de la part du directeur de l\u2019ITM, qui varient selon la taille de l\u2019entreprise et l\u2019attitude de l\u2019employeur.<br \/>\nSi une CCT existe, le droit \u00e0 la d\u00e9connexion doit \u00eatre int\u00e9gr\u00e9 dans la CCT au plus tard apr\u00e8s trois ans (dur\u00e9e maximale de validit\u00e9 d\u2019une CCT). Un avenant \u00e0 la CCT intervenant plus t\u00f4t est \u00e9videmment possible et souhaitable.<\/p>\n<p>Dans les entreprises o\u00f9 n\u2019existe aucune CCT, l\u2019employeur a un an pour mettre en place le r\u00e9gime assurant le respect du droit \u00e0 la d\u00e9connexion.<\/p>\n<p><strong>ATTENTION<\/strong> : pour l\u2019instant, il ne s\u2019agit que d\u2019une proposition, m\u00eame si elle a \u00e9t\u00e9 valid\u00e9e aussi bien par le patronat que par les syndicats. La balle est maintenant dans le camp du ministre du Travail pour soumettre dans les meilleurs d\u00e9lais un projet de loi sur la base de l\u2019accord des partenaires sociaux.<\/p>","protected":false},"author":1,"featured_media":3385,"template":"","categorie_communiques":[41],"syndicat":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
