{"id":2789,"date":"2021-03-19T13:04:29","date_gmt":"2021-03-19T12:04:29","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/une-garantie-demploi-pour-les-salaries"},"modified":"2023-06-01T11:46:14","modified_gmt":"2023-06-01T09:46:14","slug":"une-garantie-demploi-pour-les-salaries","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/une-garantie-demploi-pour-les-salaries\/","title":{"rendered":"Une garantie d\u2019emploi pour les salari\u00e9s"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p>L\u2019OGBL a sign\u00e9 le 18 mars 2021 deux plans de maintien dans l\u2019emploi sectoriels visant deux secteurs vuln\u00e9rables, \u00e0 savoir celui des agences de voyages regroup\u00e9es dans l\u2019ULAV (Union luxembourgeoise des Agences de Voyage) et le secteur de l\u2019\u00e9v\u00e9nementiel, dont les entreprises sont repr\u00e9sent\u00e9es par la LEA (Luxembourg Event Association), deux f\u00e9d\u00e9rations membres de la CLC.<\/p>\n<p>L\u2019apparition de la pand\u00e9mie COVID-19 a fortement frapp\u00e9 les secteurs du tourisme et de l\u2019\u00e9v\u00e9nementiel. Les partenaires sociaux sont conscients que la situation \u00e9conomique et financi\u00e8re de nombreuses entreprises devient alarmante alors que l\u2019incertitude r\u00e8gne dans ces deux secteurs particuli\u00e8rement vuln\u00e9rables. Une planification des activit\u00e9s est difficilement r\u00e9alisable pour ces entreprises, en raison de la persistance de la pand\u00e9mie.<\/p>\n<p>Ainsi, l\u2019OGBL s\u2019est accord\u00e9 avec l\u2019ULAV et la LEA afin de pr\u00e9venir, par tous les moyens, des licenciements ou des fermetures d\u2019\u00e9tablissements, en recourant notamment<\/p>\n<ul>\n<li>\u00e0 du ch\u00f4mage partiel, adapt\u00e9 au secteur consid\u00e9r\u00e9 par les partenaires sociaux comme fortement vuln\u00e9rable<\/li>\n<li>\u00e0 des dispositions relatives \u00e0 la formation professionnelle continue ou qualifiante<\/li>\n<li>\u00e0 une garantie de l\u2019emploi li\u00e9e \u00e0 l\u2019application des mesures<\/li>\n<li>\u00e0 l\u2019admission \u00e0 la pr\u00e9retraite-ajustement<\/li>\n<li>au pr\u00eat temporaire de main-d\u2019\u0153uvre<\/li>\n<\/ul>\n<p>Il convient de relever en particulier la garantie d\u2019emploi, gr\u00e2ce \u00e0 laquelle les entreprises profitant des mesures des plans de maintien de l\u2019emploi s\u2019engagent \u00e0 ne pas proc\u00e9der \u00e0 des licenciements \u00e9conomiques pendant la dur\u00e9e de validit\u00e9 de ces derniers.<\/p>\n<p>Le plan de maintien dans l\u2019emploi sectoriel visant les agences de voyages et les tour-op\u00e9rateurs ainsi que le plan de maintien de l\u2019emploi pour l\u2019\u00e9v\u00e9nementiel ont \u00e9t\u00e9 conclus pour une dur\u00e9e de 9 mois, respectivement de 8 mois. Sous r\u00e9serve de leur homologation par le Comit\u00e9 de conjoncture, le plan de maintien dans l\u2019emploi sectoriel conclu avec l\u2019ULAV prendra effet au 1<sup>er<\/sup> avril 2021 et s\u2019ach\u00e8vera le 31 d\u00e9cembre 2021, tandis que celui conclu avec la LEA s\u2019\u00e9tendra du 1<sup>er<\/sup> mai 2021 au 31 d\u00e9cembre 2021.<\/p>\n<p>Une commission de suivi, avec des repr\u00e9sentants de l\u2019OGBL, sera cr\u00e9\u00e9e par secteur. Ces commissions permettront de suivre p\u00e9riodiquement l\u2019\u00e9volution des actions mises en place par les partenaires sociaux et l\u2019impact qu\u2019elles ont sur le personnel.<\/p>\n<p>L\u2019OGBL salue la conclusion de ces deux accords permettant de garantir la p\u00e9rennit\u00e9 des emplois et des entreprises et souligne l\u2019importance du dialogue social en temps de crise.
