{"id":2724,"date":"2020-12-10T18:38:25","date_gmt":"2020-12-10T17:38:25","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/oui-a-lextension-du-plan-social-non-a-la-deterioration-des-conditions-initiales-pour-les-employes-restants"},"modified":"2023-06-13T09:34:05","modified_gmt":"2023-06-13T07:34:05","slug":"oui-a-lextension-du-plan-social-non-a-la-deterioration-des-conditions-initiales-pour-les-employes-restants","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/oui-a-lextension-du-plan-social-non-a-la-deterioration-des-conditions-initiales-pour-les-employes-restants\/","title":{"rendered":"Oui \u00e0 l&#8217;extension du plan social, non \u00e0 la d\u00e9t\u00e9rioration des conditions initiales pour les employ\u00e9s restants"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p><a href=\"https:\/\/www.ogbl.lu\/wp-content\/uploads\/communiques\/catella_vignette.jpg\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\" wp-image-32510 alignleft\" style=\"border: 0px none;\" src=\"https:\/\/www.ogbl.lu\/wp-content\/uploads\/communiques\/catella_vignette.jpg\" alt=\"catella_vignette\" width=\"300\" \/><\/a>L\u2019OGBL et le LCGB tiennent \u00e0 informer qu\u2019ils n&#8217;ont pas sign\u00e9 l\u2019extension du plan social de Catella Bank, pour une dur\u00e9e suppl\u00e9mentaire de 24 mois,<span style=\"text-decoration: line-through;\">\u00a0<\/span>car celui-ci \u00e9quivaut \u00e0 une d\u00e9t\u00e9rioration importante des droits des salari\u00e9s par rapport au plan social initial.<\/p>\n<p>Lorsque les repr\u00e9sentants du personnel ont contact\u00e9 les syndicats, il y a environ six mois, l&#8217;OGBL et le LCGB se sont engag\u00e9s \u00e0 ce qu\u2019en cas d\u2019extension du plan social, tous les salari\u00e9s puissent avoir acc\u00e8s aux conditions int\u00e9grales dudit plan social.<\/p>\n<p>Pour les salari\u00e9s suppos\u00e9s assurer la fermeture de la banque, il est imp\u00e9ratif que l\u2019ensemble des conditions du plan social leur soit applicable, en cas de reprise d\u2019un nouvel emploi durant la p\u00e9riode de prolongation dudit plan. Il ne saurait en aucun cas \u00eatre acceptable que les salari\u00e9s concern\u00e9s soient oblig\u00e9s de d\u00e9missionner et ainsi qu\u2019ils perdent la totalit\u00e9 de leur protection \u00e9manant du plan social.<\/p>\n<p>Il va sans dire qu\u2019une telle situation est inacceptable et bafoue les droits des salari\u00e9s concern\u00e9s. C\u2019est l\u00e0 pr\u00e9cis\u00e9ment la raison pour laquelle l\u2019OGBL et le LCGB ont refus\u00e9 de signer cette extension du plan social initial. Pour pr\u00e9sumer d\u2019un accord des syndicats, il va de soi que ces conditions doivent \u00eatre remplies. D\u2019ailleurs, notons qu\u2019elles sont d\u2019usage dans le secteur financier.<\/p>\n<p>L\u2019Aleba qui se veut \u00eatre le premier syndicat du secteur financier devrait parfaitement \u00eatre au courant de cette pratique, notamment lorsqu\u2019il s\u2019agit de fermetures de banques, car celles-ci engendrent \u00e0 court et moyen terme\u00a0la perte des emplois de tous les salari\u00e9s.<\/p>\n<p>Malheureusement, l\u2019Aleba a renonc\u00e9 \u00e0 n\u00e9gocier de meilleures conditions pour les salari\u00e9s et s\u2019est r\u00e9sign\u00e9e \u00e0 la seule prolongation du plan social.<\/p>\n<p>En tant que syndicats responsables, l\u2019OGBL et le LCGB d\u00e9plorent cette d\u00e9marche, sachant que les conditions de d\u00e9part, n\u00e9goci\u00e9es dans le cadre du plan social initial, ne sont plus respect\u00e9es.
