En effet, certains font signer aux salari\u00e9s concern\u00e9s un avenant \u00e0 leur contrat de travail. Un avenant qui est totalement superflu, mais qui peut \u00e9galement contenir des clauses parfaitement aberrantes et ambigu\u00ebs. D\u2019un point de vue l\u00e9gal, il n\u2019y a aucune n\u00e9cessit\u00e9 ni obligation de signer un nouveau contrat lors d\u2019un tel transfert. D\u2019autant plus que le salari\u00e9 risque de signer des changements substantiels par rapport \u00e0 son contrat de travail initial. Il est important de souligner que la l\u00e9gislation sur le transfert d\u2019entreprise pr\u00e9voit la reprise automatique des salari\u00e9s avec exactement les m\u00eames conditions contractuelles, c\u2019est \u00e0 dire avec tous leurs droits et obligations. Le transfert ne doit en aucun cas mener \u00e0 l\u2019introduction de clauses de contrat suppl\u00e9mentaires au d\u00e9savantage des salari\u00e9s!<br \/>\nC\u2019est la raison pour laquelle l\u2019OGBL revendique l\u2019introduction d\u2019un contrat de reprise type qui s\u2019appliquerait \u00e0 tout le secteur lors d\u2019un transfert d\u2019entreprise. Ce contrat serait ainsi annex\u00e9 \u00e0 la convention collective sectorielle et r\u00e9glerait la proc\u00e9dure une fois pour toute, sans laisser la possibilit\u00e9 aux employeurs de profiter du transfert d\u2019entreprise pour d\u00e9grader les conditions de travail.<\/p>","protected":false},"author":1,"featured_media":0,"template":"","categorie_communiques":[54],"syndicat":[73],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
