Pour arriver \u00e0 ses fins, la direction de la banque a sciemment d\u00e9cid\u00e9 de ne pas consulter le comit\u00e9 mixte au pr\u00e9alable de cette d\u00e9cision, alors que cela est pr\u00e9vu par la loi.<br \/>\nFace \u00e0 cette annonce brutale aux r\u00e9percussions graves pour le personnel employ\u00e9 dans ce service, mais \u00e9galement pour l\u2019ensemble des employ\u00e9s de la banque, la d\u00e9l\u00e9gation du personnel et l\u2019OGBL-SBA a tout de suite tent\u00e9 de stopper le processus tant que la proc\u00e9dure l\u00e9gale n\u2019a pas \u00e9t\u00e9 appliqu\u00e9e. Or la direction a malgr\u00e9 tout d\u00e9cid\u00e9 de passer outre et de proc\u00e9der aux licenciements du personnel concern\u00e9, sans leur accorder d\u2019entretien pr\u00e9alable conform\u00e9ment \u00e0 la loi.<br \/>\nL\u2019OGBL-SBA a imm\u00e9diatement saisi l\u2019ITM et demand\u00e9 son intervention urgente. L\u2019ITM a d\u00e9p\u00each\u00e9 dans la journ\u00e9e m\u00eame un inspecteur sur place, qui n\u2019a pu que confirmer la violation flagrante du droit d\u2019information et de consultation du comit\u00e9 mixte, mais \u00e9galement de la proc\u00e9dure l\u00e9gale en mati\u00e8re de licenciement. Si les licenciements n\u2019ont malheureusement pas pu \u00eatre annul\u00e9s, la banque encourt d\u00e9sormais des sanctions p\u00e9nales.<br \/>\nL\u2019OGBL-SBA salue l\u2019intervention rapide de l\u2019ITM, et veillera \u00e0 ce que dor\u00e9navant le dialogue social soit respect\u00e9 \u00e0 la lettre, sans quoi des actions syndicales relayeront les bonnes paroles.<\/p>","protected":false},"author":1,"featured_media":3963,"template":"","categorie_communiques":[52],"syndicat":[74],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
