{"id":2014,"date":"2016-04-14T14:21:27","date_gmt":"2016-04-14T12:21:27","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/un-conflit-se-prepare"},"modified":"2023-06-15T11:33:02","modified_gmt":"2023-06-15T09:33:02","slug":"un-conflit-se-prepare","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/un-conflit-se-prepare\/","title":{"rendered":"Un conflit se pr\u00e9pare"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p><a href=\"https:\/\/www.ogbl.lu\/wp-content\/uploads\/communiques\/piquet_discrimination_professions_sante_vignette.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-20114\" src=\"https:\/\/www.ogbl.lu\/wp-content\/uploads\/communiques\/piquet_discrimination_professions_sante_vignette.jpg\" alt=\"piquet_discrimination_professions_sante_vignette\" width=\"150\" height=\"150\" \/><\/a>L\u2019\u00e9volution des conditions salariales et de travail des deux conventions de travail SAS et FHL est li\u00e9e depuis des d\u00e9cennies (par l\u2019article 28) \u00e0 l\u2019\u00e9volution de l\u2019accord salarial et des r\u00e9formes des salaires et des conditions de travail dans le service public. Aupr\u00e8s de l\u2019\u00c9tat, un nouvel accord a \u00e9t\u00e9 conclu en mars 2015, apr\u00e8s de longues ann\u00e9es de n\u00e9gociations et apr\u00e8s avoir fait trainer la mise en pratique. Cet accord pr\u00e9voit le paiement d\u2019une prime unique de 0,9% et une augmentation de la valeur en points de 2,2%, qui, aupr\u00e8s de l\u2019\u00c9tat, a d\u00e9j\u00e0 \u00e9t\u00e9 vers\u00e9e entretemps.<br \/>\nLes deux conventions salariales ont \u00e9t\u00e9 d\u00e9nonc\u00e9es et les n\u00e9gociations sont en cours.<br \/>\nEn ce qui concerne la convention collective SAS, la commission paritaire, qui est sens\u00e9e calculer le volume global de l\u2019accord avec l\u2019\u00c9tat, se compose de repr\u00e9sentants d\u2019organisations patronales, de syndicats et du gouvernement. Malgr\u00e9 les garanties donn\u00e9es par le gouvernement, que la commission doit se r\u00e9unir le plus t\u00f4t possible en 2016, nous n\u2019avons jusqu\u2019\u00e0 pr\u00e9sent toujours pas eu de rendez-vous pour une premi\u00e8re r\u00e9union de la commission paritaire.<br \/>\nEn ce qui concerne la convention collective FHL, la commission paritaire se compose uniquement de la f\u00e9d\u00e9ration des h\u00f4pitaux et des syndicats. Celle-ci se r\u00e9unit d\u00e9j\u00e0, mais le mode de calcul du volume total pr\u00e9sente un certain potentiel de conflit.<br \/>\nL\u2019OGBL a pr\u00e9sent\u00e9 au sein de la commission paritaire de la convention collective FHL une m\u00e9thode de calcul, qui pr\u00e9voit de comparer l\u2019ancienne carri\u00e8re aupr\u00e8s de l\u2019\u00c9tat avec la nouvelle carri\u00e8re, et de calculer par rapport \u00e0 une carri\u00e8re \u00e0 vie l\u2019augmentation en pourcentage.<br \/>\nLa FHL n\u2019est pas d\u2019accord avec le mode de calcul de l\u2019OGBL, car elle craint que les d\u00e9penses suppl\u00e9mentaires ne seront pas couvertes par l\u2019\u00c9tat resp. par les caisses de maladie dans le cadre du \u00abBudget Global\u00bb, et propose pour cette raison une autre m\u00e9thode de calcul, qui ne correspond pas \u00e0 l\u2019article 28, mais qui est nettement moins cher.<br \/>\nLa FHL avait l\u2019intention de d\u00e9cider lors de la r\u00e9union de son comit\u00e9 directeur du 22 mars, si elle accepte le mode de calcul de l\u2019OGBL ou si elle insiste sur le maintien de sa propre proposition de mode de calcul. Cela aurait d\u00fb \u00eatre ensuite communiqu\u00e9 le lendemain aux syndicats.<br \/>\nAu lieu de nous communiquer sa position par rapport au mode de calcul, la FHL nous a soumis le 23 mars la proposition suivante:<br \/>\n&#8211;\u00a0\u00a0 \u00a0Geler la revalorisation des carri\u00e8res jusqu\u2019\u00e0 ce qu\u2019il y ait une d\u00e9cision politique de la part du gouvernement lors des n\u00e9gociations de la convention collective SAS<br \/>\n&#8211;\u00a0\u00a0 \u00a0Signer un accord provisoire, afin que l\u2019application de la convention collective FHL puisse-t-\u00eatre garantie au-del\u00e0 du 30.06.2016<br \/>\n&#8211;\u00a0\u00a0 \u00a0Verser provisoirement une partie des indemnit\u00e9s financi\u00e8res de l\u2019accord salarial dans la fonction publique<br \/>\nLa d\u00e9cision concernant l\u2019acceptation ou le refus de cette proposition sera prise au sein de la commission tarifaire par les d\u00e9l\u00e9gu\u00e9s FHL effectifs et rempla\u00e7ants de l\u2019OGBL, syndicat majoritaire dans ce secteur. Cette commission tarifaire, \u00e0 laquelle nous invitons tous les d\u00e9l\u00e9gu\u00e9s \u00e0 participer, aura lieu le 14 avril.<br \/>\nQuelle que soit la d\u00e9cision prise, la mobilisation pour les carri\u00e8res de la part de l\u2019OGBL continuera!<br \/>\nLe syndicat Sant\u00e9, Services sociaux et \u00e9ducatifs de l\u2019OGBL exige la revalorisation des professions de sant\u00e9 et sociales. Cette revalorisation, pour laquelle nous avons lutt\u00e9 ensemble avec les salari\u00e9s des secteurs concern\u00e9s, a entretemps \u00e9t\u00e9 appliqu\u00e9e dans la fonction publique. Elle doit maintenant enfin \u00eatre appliqu\u00e9e \u00e9galement dans la convention collective SAS et FHL.
