Les d\u00e9cisions sont prises sans respecter les proc\u00e9dures pr\u00e9vues par la loi.<\/p>\n<p>Depuis plusieurs mois, l\u2019entreprise souhaite introduire un syst\u00e8me de primes pour ses salari\u00e9s tenant compte des r\u00e9sultats et de diff\u00e9rents crit\u00e8res d\u2019appr\u00e9ciation individuels. Cela va sans dire que le syst\u00e8me repose sur le principe de \u00abla carotte ou le b\u00e2ton\u00bb.<\/p>\n<p>Il est pr\u00e9vu que les employ\u00e9s touchent une somme jusqu\u2019\u00e0 5 fois sup\u00e9rieure \u00e0 celle pr\u00e9vue pour les salari\u00e9s ouvriers. <i>Luxguard II<\/i> justifie cette distinction par le fait que les salari\u00e9s employ\u00e9s contribuent plus au chiffre d\u2019affaires que leurs coll\u00e8gues. Les repr\u00e9sentants de la direction ont \u00e9galement reconnu qu\u2019il fallait les r\u00e9compenser parce qu\u2019ils n\u2019\u00e9taient pas r\u00e9mun\u00e9r\u00e9s pour les heures suppl\u00e9mentaires prest\u00e9es. Ces propos ont choqu\u00e9 les repr\u00e9sentants des salari\u00e9s.<\/p>\n<p>Les repr\u00e9sentants salariaux ont demand\u00e9 \u00e0 revoir le syst\u00e8me afin de le rendre plus juste et plus transparent. La direction a refus\u00e9 de le revoir et se pr\u00e9serve le droit de le modifier \u00e0 sa guise. Face au blocage logique et l\u00e9gitime des repr\u00e9sentants salariaux, l\u2019entreprise a d\u00e9cid\u00e9 de verser en cachette une prime aux employ\u00e9s.<\/p>\n<p>Dernier fait en date: lors d\u2019une r\u00e9union en pr\u00e9sence des membres du comit\u00e9 mixte et de la d\u00e9l\u00e9gation du personnel, la direction a inform\u00e9 les parties qu\u2019elle \u00e9tait en train de mettre en place plus de moyens et d\u2019outils pour garantir la s\u00e9curit\u00e9 des salari\u00e9s. Ceci fait suite \u00e0 une s\u00e9rie d\u2019accidents du travail depuis le d\u00e9but de l\u2019ann\u00e9e. Les repr\u00e9sentants salariaux ont de nouveau \u00e9t\u00e9 mis devant le fait accompli et n\u2019ont pas \u00e9t\u00e9 impliqu\u00e9s dans ce processus. Le d\u00e9l\u00e9gu\u00e9 \u00e0 la s\u00e9curit\u00e9, quant \u00e0 lui, n\u2019\u00e9tait m\u00eame pas au courant et il n\u2019a pas pu \u00eatre lib\u00e9r\u00e9 par l\u2019organisation pour assister \u00e0 la r\u00e9union d\u2019information.<\/p>\n<p><b>Un conflit social in\u00e9vitable?<\/b><b><\/b><\/p>\n<p>L\u2019OGBL ne peut pas tol\u00e9rer ni accepter cette mani\u00e8re d\u2019agir. Les repr\u00e9sentants du personnel assist\u00e9s par l\u2019OGBL sont donc contraints de saisir les instances comp\u00e9tentes afin de garantir le respect des droits de l\u2019ensemble des salari\u00e9s.
