{"id":1836,"date":"2015-02-26T16:24:27","date_gmt":"2015-02-26T15:24:27","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/renouvellement-de-la-convention-collective-21"},"modified":"2023-06-14T10:37:09","modified_gmt":"2023-06-14T08:37:09","slug":"renouvellement-de-la-convention-collective-21","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/renouvellement-de-la-convention-collective-21\/","title":{"rendered":"Renouvellement de la convention collective"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p><\/p>\n<p style=\"text-align: left;\"><a href=\"https:\/\/www.ogbl.lu\/wp-content\/uploads\/communiques\/fss.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-18192\" src=\"https:\/\/www.ogbl.lu\/wp-content\/uploads\/communiques\/fss.jpg\" alt=\"fss\" width=\"500\" height=\"243\" \/><\/a><\/p>\n<p style=\"text-align: left;\">Fedil Security Services* et les syndicats OGBL et LCGB viennent de renouveler la convention collective de travail du secteur de la s\u00e9curit\u00e9 priv\u00e9e au Luxembourg pour une nouvelle dur\u00e9e de trois ans (1er mars 2015 au 28 f\u00e9vrier 2018).<\/p>\n<p>Ainsi, ils ont r\u00e9gl\u00e9 les conditions de travail et de r\u00e9mun\u00e9ration de quelque 2.600 agents des soci\u00e9t\u00e9s de service de s\u00e9curit\u00e9 et de gardiennage au Luxembourg.<\/p>\n<p>Les parties ont convenu d\u2019organiser dor\u00e9navant la dur\u00e9e du travail sur base d\u2019une p\u00e9riode de r\u00e9f\u00e9rence de 12 mois. L\u2019extension de la p\u00e9riode de r\u00e9f\u00e9rence a \u00e9t\u00e9 convenue alors que l\u2019activit\u00e9 des entreprises du secteur de la s\u00e9curit\u00e9 priv\u00e9e conna\u00eet des variations importantes sur l\u2019ann\u00e9e. En outre, dans une approche d\u2019am\u00e9lioration des conditions de travail des salari\u00e9s du secteur, une p\u00e9riode de r\u00e9f\u00e9rence prolong\u00e9e permettra d\u2019entourer des p\u00e9riodes de forte activit\u00e9 de p\u00e9riodes de repos afin d\u2019\u00e9viter des absences au travail. De plus, la p\u00e9riode de r\u00e9f\u00e9rence prolong\u00e9e permettra d\u2019aider de maintenir les salari\u00e9s dans l\u2019emploi en cas de perte de march\u00e9 si le volume des heures du march\u00e9 entrant est inf\u00e9rieur au volume d\u2019heures du march\u00e9 sortant et que de ce fait l\u2019entreprise se retrouve avec du personnel en sureffectif. Enfin, le p\u00e9riode de r\u00e9f\u00e9rence de 12 mois devrait servir \u00e0 limiter le recours aux contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e.<\/p>\n<p>Les partenaires sociaux ont \u00e9galement d\u00e9cid\u00e9 la mise en place, jusqu\u2019\u00e0 la fin de la dur\u00e9e de la convention collective, d\u2019un fonds de formation sectoriel. Le projet \u00e9tant \u00e9volutif dans le temps, les partenaires sociaux ont fix\u00e9 dans l\u2019avenant \u00e0 la convention collective les \u00e9tapes ainsi que l\u2019\u00e9ch\u00e9ancier pr\u00e9visionnel de la mise en oeuvre du projet.<\/p>\n<p>De m\u00eame, les partenaires sociaux ont convenu de r\u00e9glementer sur base sectorielle le sort du personnel lorsqu\u2019un contrat est arriv\u00e9 \u00e0 \u00e9ch\u00e9ance ou rompu anticipativement pour une entreprise (c\u00e9dant) et que lors d\u2019une nouvelle adjudication ou suivant une autre proc\u00e9dure un nouveau contrat similaire sinon identique quant \u00e0 l\u2019objet est attribu\u00e9 \u00e0 une autre entreprise (cessionnaire). Il a \u00e9t\u00e9 d\u00e9cid\u00e9 d\u2019ins\u00e9rer un nouvel article dans la convention collective relatif \u00e0 la reprise de personnel en cas de perte de march\u00e9.<\/p>\n<p>Les partenaires sociaux constatent que le secteur est confront\u00e9 \u00e0 un taux d\u2019absent\u00e9isme important. Ils ont convenu de solliciter, sur base d\u2019une demande conjointe aupr\u00e8s de l\u2019Observatoire de l\u2019absent\u00e9isme, des statistiques plus cibl\u00e9es sur les absences des entreprises couvertes par la pr\u00e9sente convention collective. Sur base de ces statistiques, les partenaires sociaux ont convenu de proc\u00e9der, dans le cadre de la commission paritaire pr\u00e9vue par la convention collective, \u00e0 une analyse et \u00e0 la recherche commune de rem\u00e8des afin de r\u00e9duire les absences au travail dans le secteur de la s\u00e9curit\u00e9 priv\u00e9e.<\/p>\n<p>En outre, les syndicats signataires de la convention collective s\u2019engagent \u00e0 entreprendre, au niveau des entreprises du secteur, des actions visant \u00e0 sensibiliser et \u00e0 former les salari\u00e9s en vue d\u2019arriver \u00e0 une baisse de l\u2019absent\u00e9isme.<\/p>\n<p>Une augmentation lin\u00e9aire de 0,5% des salaires de l\u2019ensemble du personnel tombant sous le champ d\u2019application de la convention collective a \u00e9t\u00e9 retenue \u00e0 partir du 1er janvier 2017.<\/p>\n<p>Les partenaires sociaux ont convenu de solliciter la d\u00e9claration d\u2019obligation g\u00e9n\u00e9rale de l\u2019avenant avec effet r\u00e9troactif \u00e0 la date d\u2019entr\u00e9e en vigueur de la convention collective.<\/p>\n<p>Les salari\u00e9s du secteur sont ainsi en droit d\u2019exiger l\u2019application stricte des conditions pr\u00e9vues par la convention collective m\u00eame si leur employeur n\u2019est pas membre de l\u2019organisation repr\u00e9sentative des entreprises de s\u00e9curit\u00e9 priv\u00e9e au Luxembourg, Fedil Security Services.<\/p>\n<p><strong>Communiqu\u00e9 par le syndicat Services et Energie de l\u2019OGBL le 26 f\u00e9vrier 2015<\/strong><\/p>\n<h5><em>* Fedil Security Services est une association sectorielle de Fedil &#8211; Business Federation Luxembourg et regroupe les entreprises Brink&#8217;s Security Luxembourg, Dussmann Security, G4S Security Solutions, Prosegur Security Luxembourg et Securitas Luxembourg.<\/em><\/h5>\n<p><\/p>","protected":false},"author":1,"featured_media":4232,"template":"","categorie_communiques":[54],"syndicat":[73],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
