{"id":1607,"date":"2013-11-18T12:51:16","date_gmt":"2013-11-18T11:51:16","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/droit-au-maintien-integral-du-salaire-en-cas-dincapacite-de-travail"},"modified":"2023-05-23T19:44:16","modified_gmt":"2023-05-23T17:44:16","slug":"droit-au-maintien-integral-du-salaire-en-cas-dincapacite-de-travail","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/droit-au-maintien-integral-du-salaire-en-cas-dincapacite-de-travail\/","title":{"rendered":"Droit au maintien int\u00e9gral du salaire en cas d\u2019incapacit\u00e9 de travail"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p>La Cour de cassation du Grand-Duch\u00e9 de Luxembourg a rendu en date du 4 juillet 2013 un arr\u00eat disposant qu\u2019un <strong>salari\u00e9 incapable de travailler a droit,<\/strong> pour la p\u00e9riode de son incapacit\u00e9 de travail, <strong>au maintien int\u00e9gral de son salaire et des autres avantages r\u00e9sultant de son contrat de travail <\/strong>y compris les suppl\u00e9ments ou et majorations pour le travail de nuit, de dimanche et de jours f\u00e9ri\u00e9s.<\/p>\n<p>Or, dans certaines entreprises nous restons confront\u00e9s au quotidien \u00e0 la situation qu\u2019elles ne s\u2019alignent pas aux conclusions dudit arr\u00eat. Etant donn\u00e9 que toutes ces entreprises sont membres de l\u2019Union luxembourgeoise des entreprises (UEL), l\u2019OGBL vient d\u2019adresser une lettre \u00e0 la f\u00e9d\u00e9ration patronale l\u2019exhortant \u00e0 intervenir d\u2019urgence aupr\u00e8s des entreprises refusant l\u2019application de l\u2019arr\u00eat tout en insistant sur le fait que le comportement de ces entreprises discr\u00e9dite l\u2019ensemble des entreprises luxembourgeoises.<\/p>\n<p>L\u2019OGBL invite l\u2019UEL \u00e0 prendre position conform\u00e9ment \u00e0 la loi luxembourgeoise afin de faire avancer ce dossier litigieux et afin d\u2019amener les entreprises luxembourgeoises \u00e0 payer dor\u00e9navant la r\u00e9mun\u00e9ration due \u00e0 leurs salari\u00e9s. L\u2019OGBL l\u2019invite \u00e0 entamer les efforts n\u00e9cessaires afin que ce dossier soit cl\u00f4tur\u00e9 dans les plus brefs d\u00e9lais.<\/p>\n<p>Pour bon nombre de salari\u00e9s en maladie, l\u2019attitude de certaines entreprises entra\u00eene de graves probl\u00e8mes financiers comme souvent ils subissent des pertes de salaire substantielles. De ce fait, la position des entreprises est profond\u00e9ment antisociale, nullement justifi\u00e9e et contraire \u00e0 la loi luxembourgeoise qui pr\u00e9voit la conservation int\u00e9grale du salaire m\u00eame en cas d\u2019absence de prestation effective de travail par le salari\u00e9 malade.<\/p>\n<p>L\u2019OGBL <strong>appelle tous les salari\u00e9s concern\u00e9s par ce probl\u00e8me de s\u2019adresser imm\u00e9diatement \u00e0 leurs d\u00e9l\u00e9gu\u00e9s OGBL dans l\u2019entreprise<\/strong>, soutenus par le plus puissant syndicat du Luxembourg, qui les aideront concr\u00e8tement dans les d\u00e9marches et continueront \u00e0 se battre pour leur droit au maintien int\u00e9gral du salaire en cas d\u2018incapacit\u00e9 de travail.<\/p>","protected":false},"author":1,"featured_media":0,"template":"","categorie_communiques":[38,128,126,127],"syndicat":[113,112,100],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
