{"id":1352,"date":"2013-01-10T16:05:12","date_gmt":"2013-01-10T15:05:12","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/logbl-salue-linitiative-du-gouvernement"},"modified":"2023-07-03T10:14:12","modified_gmt":"2023-07-03T08:14:12","slug":"logbl-salue-linitiative-du-gouvernement","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/en\/communique\/logbl-salue-linitiative-du-gouvernement\/","title":{"rendered":"L\u2019OGBL salue l\u2019initiative du gouvernement"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\"> <\/p><p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-7369\" title=\"justice_balance\" src=\"https:\/\/www.ogbl.lu\/wp-content\/uploads\/communiques\/justice_balance.gif\" alt=\"\" width=\"150\" height=\"113\" \/>Compte tenu de l\u2019augmentation importante du nombre de faillites depuis 2009, l\u2019OGBL salue le fait que le gouvernement ait enfin adopt\u00e9 un projet de loi dans ce domaine.<\/p>\n<p>L\u2019OGBL demande depuis plusieurs ann\u00e9es que les dispositions l\u00e9gales en mati\u00e8re de faillite soient r\u00e9vis\u00e9es et am\u00e9lior\u00e9es surtout en ce qui concerne le droit des salari\u00e9s. L\u2019OGBL note que la nouvelle loi visera \u00e0 pr\u00e9server l\u2019activit\u00e9 de l\u2019entreprise et ses emplois. Le gouvernement confirme le volet introduit dans le Code du travail en avril 2012 relatif au paiement aux salari\u00e9s concern\u00e9s par une faillite d\u2019avances sur les salaires impay\u00e9s.<\/p>\n<p>En mettant l\u2019accent sur le volet pr\u00e9ventif permettant une d\u00e9tection le plus t\u00f4t possible d\u2019une entreprise en difficult\u00e9s, le gouvernement satisfait \u00e9galement une ancienne revendication syndicale. Car, les entreprises concern\u00e9es arr\u00eatent souvent de payer la TVA ou les cotisations sociales. C\u2019est alors qu\u2019un syst\u00e8me d\u2019alerte aurait depuis longtemps d\u00fb \u00eatre mis en place. L\u2019OGBL ne peut donc que saluer la disposition qui pr\u00e9voit de centraliser un certain nombre de donn\u00e9es des d\u00e9biteurs en difficult\u00e9s aupr\u00e8s du secr\u00e9tariat du Comit\u00e9 de conjoncture qui se voit octroyer comme nouveau r\u00f4le de suivre la situation des d\u00e9biteurs \u00e0 probl\u00e8me en vue de favoriser la continuation de leur entreprise.<\/p>\n<p>Avant de se prononcer plus en d\u00e9tail sur le projet de loi, l\u2019OGBL en fera une analyse approfondie.<\/p>\n<p><strong>Communiqu\u00e9 par l\u2019OGBL<\/strong><br \/>\n<strong> le 10 janvier 2013<\/strong><\/p>","protected":false},"author":1,"featured_media":4513,"template":"","categorie_communiques":[41],"syndicat":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
