\"\"<\/a>Dans un arr\u00eat du 14 juin 2012 la Cour Europ\u00e9enne de Justice, dans une affaire Commission Europ\u00e9enne contre Royaume des Pays-Bas, vient de confirmer qu\u2019une aide au financement des \u00e9tudes sup\u00e9rieures d\u2019enfants de travailleurs frontaliers est \u00e0 consid\u00e9rer comme un avantage social qui leur est d\u00fb sans qu\u2019une condition de r\u00e9sidence ne puisse leur \u00eatre impos\u00e9e.<\/p>\n

Tous les arguments utilis\u00e9s \u00e9galement par le gouvernement luxembourgeois ont \u00e9t\u00e9 invalid\u00e9s: L\u2019enfant peut se pr\u00e9valoir de l\u2019avantage social du fait de la qualit\u00e9 de travailleur migrant d\u2019un de ses parents, m\u00eame si l\u2019aide pour \u00e9tudes sup\u00e9rieures lui est attribu\u00e9e directement comme \u00e9tudiant, principal argument du gouvernement luxembourgeois en la mati\u00e8re. La r\u00e9f\u00e9rence aux arr\u00eats BIDAR et FOERSTER est balay\u00e9e comme \u00e9tant inapplicable en mati\u00e8re de travailleurs frontaliers. L\u2019argument de la charge financi\u00e8re apparemment d\u00e9raisonnable a \u00e9galement \u00e9t\u00e9 \u00e9cart\u00e9.<\/p>\n

Il faut constater que les jeux sont faits et que toutes les contorsions habituelles du ministre de l\u2019Enseignement sup\u00e9rieur ne suffiront plus \u00e0 berner l\u2019opinion publique.<\/p>\n

L\u2019OGBL exige du gouvernement qu\u2019il termine la bataille juridique co\u00fbteuse pour le contribuable et qu\u2019il reconnaisse par d\u00e9cision politique et avec effet r\u00e9troactif \u00e0 tous les enfants de travailleurs frontaliers le droit \u00e0 l\u2019aide financi\u00e8re pour \u00e9tudiants.
