Le non-respect des salari\u00e9s et de la convention collective ainsi qu\u2019une politique de menaces et de chantage sont quotidiennement au menu, de m\u00eame que des entraves au bon fonctionnement de la d\u00e9l\u00e9gation.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Entraves au bon fonctionnement de la d\u00e9l\u00e9gation<\/strong><\/p>\n<p>Quelques exemples:\u00a0 pour toutes les r\u00e9unions, qu\u2019elles soient dans le cadre de la convention collective ou que ce soient des r\u00e9unions d\u2019information pour le personnel, la direction trouve toujours des arguments \u00e0 ne pas lib\u00e9rer toute la d\u00e9l\u00e9gation de sorte que 2 \u00e0 4 personnes manquent \u00e0 chaque r\u00e9union. L\u2019OGBL d\u00e9nonce cette fa\u00e7on d\u2019emp\u00eacher le travail en \u00e9quipe de la d\u00e9l\u00e9gation ce qui constitue selon le Code du travail une entrave au bon fonctionnement de la d\u00e9l\u00e9gation.<\/p>\n<p>La soci\u00e9t\u00e9 ne respecte pas non plus sa propre convention collective. Ainsi, quand\u00a0 la soci\u00e9t\u00e9 a d\u00e9cid\u00e9 de passer de 3 \u00e0 4 postes, la direction n\u2019a donn\u00e9 qu\u2019un pr\u00e9avis de 11 jours sous pr\u00e9texte qu\u2019il fallait agir vite, alors que le d\u00e9lai est de 21 jours. A quoi sert une convention collective si elle n\u2019est pas respect\u00e9e?<\/p>\n<p>Lors d\u2019une r\u00e9cente r\u00e9union du comit\u00e9 mixte, et malgr\u00e9 le passage \u00e0 quatre postes qui est signe d\u2019une bonne \u00e9volution \u00e9conomique, la direction annon\u00e7ait\u00a0 \u00e0 l\u2019occasion le licenciement de deux personnes pour raisons \u00e9conomiques. La d\u00e9l\u00e9gation a de s\u00e9rieux doutes quant aux arguments \u00e9conomiques avanc\u00e9es pour ces deux licenciements, car la direction refuse cat\u00e9goriquement de produire les preuves de ses difficult\u00e9s \u00e9conomiques, p.ex. sous forme de bilan ou de compte de profits et pertes.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>R\u00e9union de la derni\u00e8re chance<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Pour d\u00e9noncer la violation r\u00e9p\u00e9t\u00e9e de la l\u00e9gislation du travail, l\u2019OGBL est intervenu aupr\u00e8s de l\u2019Inspection du travail et des mines (ITM) et a d\u00e9cid\u00e9 de saisir \u00e9galement le ministre du Travail de m\u00eame que la direction g\u00e9n\u00e9rale de la soci\u00e9t\u00e9 en Isra\u00ebl.<\/p>\n<p>En date du 14 septembre, la d\u00e9l\u00e9gation du personnel et les responsables de l\u2019OGBL avaient organis\u00e9 une r\u00e9union avec tout le personnel de Curver et ceci en pr\u00e9sence de la direction. Plus de 82% des participants d\u00e9claraient leur m\u00e9contentement face \u00e0 la situation actuelle et faisaient savoir qu\u2019ils attendaient plus qu\u2019une simple reconnaissance financi\u00e8re de leurs efforts des derni\u00e8res ann\u00e9es pour assurer la survie du site luxembourgeois:\u00a0 un traitement respectueux de la part de la direction. En retour, les personnes qui se sont manifest\u00e9es pendant ces r\u00e9unions ont eu des menaces de licenciement.<\/p>\n<p>Suite \u00e0 la pression maintenue par la d\u00e9l\u00e9gation et l\u2019OGBL, la direction vient de demander une r\u00e9union autour de la table des n\u00e9gociations.
