{"id":826,"date":"2010-11-02T13:35:00","date_gmt":"2010-11-02T12:35:00","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/la-direction-met-une-museliere-a-la-delegation"},"modified":"2023-06-02T13:45:30","modified_gmt":"2023-06-02T11:45:30","slug":"la-direction-met-une-museliere-a-la-delegation","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/de\/communique\/la-direction-met-une-museliere-a-la-delegation\/","title":{"rendered":"La direction met une museli\u00e8re \u00e0 la d\u00e9l\u00e9gation"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-de\"> <\/p><p>Dans le contexte du renouvellement de la convention collective de travail et la r\u00e9union \u00e0 l\u2019Office national de conciliation le 7 octobre, la direction de Catalyst Porocel Luxembourg a organis\u00e9 une r\u00e9union d\u2019information pour l\u2019ensemble du personnel de la soci\u00e9t\u00e9 avec un seul but : exposer ses vues sur les n\u00e9gociations pour le renouvellement de la convention collective.<\/p>\n<p>Lorsque la d\u00e9l\u00e9gation du personnel a demand\u00e9 la parole afin de pouvoir donner son point de vue sur les n\u00e9gociations, la direction lui a interdit d\u2019intervenir \u00e0 ce sujet. Cette attitude a par ailleurs \u00e9t\u00e9 tr\u00e8s mal per\u00e7ue par le personnel qui doute des bonnes intentions de leur patron, alors qu\u2019il s\u2019efforce de mettre une museli\u00e8re aux d\u00e9l\u00e9gu\u00e9s.Ce nouveau fait s\u2019inscrit dans une longue liste de pressions et de discriminations envers la d\u00e9l\u00e9gation du personnel qui agit pourtant dans le plus strict respect de la loi et qui essaie de repr\u00e9senter au mieux l\u2019ensemble du personnel et de d\u00e9fendre le mandat re\u00e7u par celui-ci.<\/p>\n<p>Cette fois-ci, plus concr\u00e8tement, la direction pr\u00e9tend que pendant une proc\u00e9dure de conciliation elle n\u2019aurait pas le droit de discuter avec les partenaires sociaux sans la pr\u00e9sence du conciliateur. Etonnant, car le message du conciliateur \u00e9tait clair et sans \u00e9quivoque : discuter ensemble pour trouver un accord. Par ailleurs, il ne reste plus que quelques points de divergences en ce qui concerne le renouvellement de la convention collective, en l\u2019occurrence :<br \/>\n\u2022 l\u2019augmentation de la participation au b\u00e9n\u00e9fice qui est aujourd\u2019hui de 4% \u00e0 6%. Cette revendication remplace l\u2019augmentation lin\u00e9aire demand\u00e9e en d\u00e9but des n\u00e9gociations et refus\u00e9e cat\u00e9goriquement par la soci\u00e9t\u00e9.<br \/>\n\u2022 mise en place d\u2019un syst\u00e8me d\u2019\u00e9valuation du personnel dont les crit\u00e8res seraient \u00e9labor\u00e9s ensemble par les partenaires sociaux (direction, d\u00e9l\u00e9gation du personnel et l\u2019OGBL).<br \/>\nLa d\u00e9l\u00e9gation et l\u2019OGBL avaient pr\u00e9vu d\u2019informer le personnel au cours d\u2019une r\u00e9union pl\u00e9ni\u00e8re, pendant les heures de travail, conform\u00e9ment \u00e0 l\u2019article 415-8 du Code du travail. Or, la direction s\u2019obstine \u00e0 interpr\u00e9ter la loi \u00e0 sa mani\u00e8re en interdisant au personnel de participer \u00e0 une telle r\u00e9union, mena\u00e7ant le personnel de sanctions graves en cas de participation. Elle va m\u00eame jusqu\u2019\u00e0 expliquer au personnel qu\u2019une r\u00e9union pl\u00e9ni\u00e8re s\u2019apparente \u00e0 une action contre la soci\u00e9t\u00e9 et la compare \u00e0 une action de gr\u00e8ve ou de lock-out.<\/p>\n<p>Refusant de jouer aux incendiaires, la d\u00e9l\u00e9gation et son syndicat renoncent actuellement et pour la seconde fois \u00e9ndeans un mois \u00e0 cette proc\u00e9dure, mais se r\u00e9servent le droit d\u2019y revenir si la situation devait s\u2019empirer.<\/p>\n<p>Un ultime appel est lanc\u00e9 \u00e0 la direction d\u2019arr\u00eater ce jeu malsain, car il n\u2019est pas question de gagner, il s\u2019agit de trouver une solution dans un dialogue ouvert et constructif.<\/p>\n<p><strong>Communiqu\u00e9 par le Syndicat Bois, Caoutchouc, C\u00e9ramique, Chimie.
