{"id":816,"date":"2010-08-11T10:55:54","date_gmt":"2010-08-11T08:55:54","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/accord-signe-4"},"modified":"2023-05-26T13:19:06","modified_gmt":"2023-05-26T11:19:06","slug":"accord-signe-4","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/de\/communique\/accord-signe-4\/","title":{"rendered":"Accord sign\u00e9"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-de\"> <\/p><p>Apr\u00e8s trois r\u00e9unions de n\u00e9gociations entre le syndicat OGBL et la soci\u00e9t\u00e9 DVL.TV S.A. (LUXE.TV), repr\u00e9sent\u00e9e par l\u2019administrateur et \u00abGeneral Manager\u00bb Jacques Rousseau, un plan social pour 24 salari\u00e9s a \u00e9t\u00e9 sign\u00e9 en date du 10 ao\u00fbt 2010.<\/p>\n<p>Depuis sa cr\u00e9ation il y a cinq ans, la soci\u00e9t\u00e9 DVL.TV affiche une perte importante au niveau de son r\u00e9sultat. Selon les responsables de cette soci\u00e9t\u00e9, au vu de cette situation, seule une r\u00e9orientation strat\u00e9gique pourrait permettre \u00e0 DVL.TV d\u2019y rem\u00e9dier.<\/p>\n<p>La d\u00e9cision a d\u00e8s lors \u00e9t\u00e9 prise de restructurer profond\u00e9ment DVL.TV et de cesser pour une dur\u00e9e ind\u00e9termin\u00e9e la plupart de ses activit\u00e9s, principalement les activit\u00e9s de production et de postproduction ainsi que les services de support de ces activit\u00e9s. DVL.TV ne conservera donc qu\u2019une activit\u00e9 limit\u00e9e de diffusion et quelques fonctions de support.<\/p>\n<p>DVL.TV emploie actuellement 37 salari\u00e9s, dont 19 sont affect\u00e9s aux activit\u00e9s de production et de postproduction, 8 \u00e0 l\u2019activit\u00e9 de diffusion, 4 au d\u00e9partement Sales\/Marketing et 6 sont occup\u00e9s dans les services administratifs.<\/p>\n<p>DVL.TV maintiendra le contrat de travail des employ\u00e9s affect\u00e9s \u00e0 des fonctions de diffusion et \u00e0 quelques fonctions administratives afin de continuer une partie de l\u2019activit\u00e9 de diffusion, soit un total de 13 salari\u00e9s. C\u2019est donc pour les autres 24 salari\u00e9s vis\u00e9es par ce licenciement collectif qu\u2019a \u00e9t\u00e9 n\u00e9goci\u00e9 un plan social, afin d\u2019att\u00e9nuer les dommages mat\u00e9riels et moraux que subiront ces salari\u00e9s.<\/p>\n<p>En sus des d\u00e9lais de pr\u00e9avis et des indemnit\u00e9s l\u00e9gales il a \u00e9t\u00e9 n\u00e9goci\u00e9 les compensations extral\u00e9gales suivantes :<\/p>\n<ul>\n<li>dispense de toute prestation de travail pendant le pr\u00e9avis, avec maintien de l\u2019int\u00e9gralit\u00e9 du salaire;<\/li>\n<li>en cas d\u2019un nouvel emploi pendant le pr\u00e9avis ou d\u2019activit\u00e9 \u00e0 titre d\u2019ind\u00e9pendant, DVL.TV continuera de verser l\u2019int\u00e9gralit\u00e9 du salaire pendant la dur\u00e9e du pr\u00e9avis restant \u00e0 courir;<\/li>\n<li>les cong\u00e9s non pris \u00e0 la date du 15 ao\u00fbt 2010 ainsi que les cong\u00e9s d\u00fbs jusqu\u2019\u00e0 l\u2019expiration du pr\u00e9avis seront pay\u00e9s \u00e0 l\u2019expiration du pr\u00e9avis.<\/li>\n<\/ul>\n<p>Les salari\u00e9s licenci\u00e9s b\u00e9n\u00e9ficieront d\u2019une indemnit\u00e9 volontaire de licenciement qui sera calcul\u00e9e en fonction de l\u2019anciennet\u00e9 comme suit:<\/p>\n<ul>\n<li>anciennet\u00e9 inf\u00e9rieure ou \u00e9gale \u00e0 13 mois, indemnit\u00e9 \u00e9gale \u00e0 280 \u20ac par mois d\u2019anciennet\u00e9,<\/li>\n<li>anciennet\u00e9 comprise entre 14 et 24 mois, indemnit\u00e9 \u00e9gale \u00e0 210 \u20ac par mois d\u2019anciennet\u00e9,<\/li>\n<li>anciennet\u00e9 comprise entre 25 et 36 mois, indemnit\u00e9 \u00e9gale \u00e0 200 \u20ac par mois d\u2019anciennet\u00e9,<\/li>\n<li>anciennet\u00e9 sup\u00e9rieure \u00e0 36 mois, indemnit\u00e9 \u00e9gale \u00e0 190 \u20ac par mois.<\/li>\n<\/ul>\n<p>Un accompagnement professionnel sera offert aux salari\u00e9s licenci\u00e9s qui pr\u00e9voit une assistance individuelle de la part d\u2019une soci\u00e9t\u00e9 (outplacement) sp\u00e9cialis\u00e9e en mati\u00e8re de recherche d\u2019emploi et\/ou de formation. Cette mesure aura un co\u00fbt de 1.500 \u20ac par salari\u00e9. Si le salari\u00e9 renonce \u00e0 ces mesures sociales d\u2019accompagnement, il pourra demander en contrepartie le paiement du montant de 1.500 \u20ac. Ce montant sera alors consid\u00e9r\u00e9 au m\u00eame titre que les indemnit\u00e9s de d\u00e9part volontaires.<\/p>\n<p>Le plan social s\u2019applique \u00e0 compter de sa signature et jusqu\u2019au 12\u00e8me mois suivant sa signature.<\/p>\n<p>Dans l\u2019hypoth\u00e8se o\u00f9 DVL.TV devait \u00eatre amen\u00e9e \u00e0 cesser d\u00e9finitivement ses activit\u00e9s dans l\u2019ann\u00e9e suivant la signature du plan social et suivant le licenciement des 24 personnes, les salari\u00e9s restants aupr\u00e8s de DVL.TV b\u00e9n\u00e9ficieront \u00e9galement des avantages sociaux li\u00e9s au pr\u00e9sent plan social, sans qu\u2019une nouvelle proc\u00e9dure de licenciements collectifs soit mise en place. L\u2019OGBL souligne n\u00e9anmoins qu\u2019il faudra rester tr\u00e8s vigilant sur l\u2019\u00e9volution de ce dossier.
