{"id":745,"date":"2010-03-25T14:43:20","date_gmt":"2010-03-25T13:43:20","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/signature-du-plan-social-de-markant-lux-s-a"},"modified":"2023-06-01T14:38:43","modified_gmt":"2023-06-01T12:38:43","slug":"signature-du-plan-social-de-markant-lux-s-a","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/de\/communique\/signature-du-plan-social-de-markant-lux-s-a\/","title":{"rendered":"Signature du plan social de Markant-Lux S.A."},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-de\"> <\/p><p>Apr\u00e8s des n\u00e9gociations qui ont d\u00e9but\u00e9 le 10 mars dernier en vue de l\u2019\u00e9tablissement d\u2019un plan social pour les salari\u00e9s de la soci\u00e9t\u00e9 Markant-Lux S.A., ce plan a \u00e9t\u00e9 sign\u00e9 le 24 mars 2010, par la soci\u00e9t\u00e9, par l\u2019OGBL, en tant que seul syndicat repr\u00e9sent\u00e9 au sein de la d\u00e9l\u00e9gation du personnel et signataire de la convention collective de travail de Markant-Lux S.A., par le LCGB, en tant que signataire de la m\u00eame convention collective et par la d\u00e9l\u00e9gation du personnel.<\/p>\n<p>Le plan social permet, dans ses grandes lignes, la garantie du maintien dans l\u2019emploi du personnel de Markant-Lux.<\/p>\n<p>Ce plan stipule :<\/p>\n<ul>\n<li>que la soci\u00e9t\u00e9 s\u2019engage \u00e0 reclasser les 63 salari\u00e9s concern\u00e9s (les salari\u00e9s ayant un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e et les g\u00e9rants) dans un autre \u00e9tablissement au Luxembourg appartenant au groupe Delhaize;<\/li>\n<li>que les nouveaux contrats de travail au sein d\u2019une autre soci\u00e9t\u00e9 du groupe Delhaize seront \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, sans p\u00e9riode d\u2019essai et avec la charge horaire hebdomadaire au minimum \u00e9quivalente aux contrats actuels;<\/li>\n<li>que, en cas de licenciement de la part du nouvel employeur du groupe Delhaize, le salari\u00e9 aura droit \u00e0 un d\u00e9lai de pr\u00e9avis minimum correspondant \u00e0 son anciennet\u00e9 au sein de la soci\u00e9t\u00e9 Markant-Lux S.A.. Aussi, et dans ces m\u00eames conditions, les salari\u00e9s gardent une garantie d\u2019acc\u00e8s \u00e0 l\u2019indemnit\u00e9 de d\u00e9part due \u00e0 son anciennet\u00e9 aupr\u00e8s de Markant-Lux. Cette garantie est octroy\u00e9e en fonction du nombre d\u2019ann\u00e9es travaill\u00e9es aupr\u00e8s de Markant-Lux et a une dur\u00e9e maximale de 24 mois;<\/li>\n<li>Que la soci\u00e9t\u00e9 s\u2019engage \u00e0 entreprendre les d\u00e9marches n\u00e9cessaires aupr\u00e8s de l\u2019Etat quant \u00e0 l\u2019obtention d\u2019aides l\u00e9gales, notamment d\u2019une aide au r\u00e9emploi, pour que les salari\u00e9s ayant accept\u00e9 ce reclassement puissent b\u00e9n\u00e9ficier d\u2019un niveau salarial proche du salaire per\u00e7u aujourd\u2019hui au sein de Markant-Lux et ce, pendant une p\u00e9riode de transition; sous condition qu\u2019\u00e0 la fin de cette p\u00e9riode ces salari\u00e9s retrouveront un salaire \u00e9quivalent \u00e0 celui qu\u2019ils per\u00e7oivent aujourd\u2019hui au sein de la soci\u00e9t\u00e9 Markant-Lux;<\/li>\n<li>que les salari\u00e9s qui n\u2019acceptent pas ce reclassement dans un autre \u00e9tablissement appartenant au groupe Delhaize au Luxembourg seront licenci\u00e9s avec pr\u00e9avis et recevront une indemnit\u00e9 de d\u00e9part en fonction de leur anciennet\u00e9. Cette indemnit\u00e9 de d\u00e9part sera augment\u00e9e d\u2019un mois de salaire. Le d\u00e9lai de pr\u00e9avis sera aussi augment\u00e9 d\u2019un mois suppl\u00e9mentaire \u00e0 celui l\u00e9galement pr\u00e9vu.<\/li>\n<\/ul>\n<p>La soci\u00e9t\u00e9 Markant-Lux S.A. a \u00e9t\u00e9 acquise \u00e0 100% par la soci\u00e9t\u00e9 Delhaize Luxembourg S.A. en f\u00e9vrier 2010 et exploite les magasins des enseignes AD Delhaize et Proxy Delhaize de Differdange, Ettelbr\u00fcck, Gasperich et Wiltz. Les activit\u00e9s dans ces \u00e9tablissements cesseront pour motif \u00e9conomique (d\u00e9molition des b\u00e2timents) au plus tard le 31 d\u00e9cembre 2010 \u00e0 Differdange, Ettelbr\u00fcck et Wiltz, respectivement le 31 d\u00e9cembre 2012 \u00e0 Gasperich.<\/p>\n<p><strong>Communiqu\u00e9 par l\u2019OGBL et le LCGB<\/strong><br \/>\n<strong>le 25 mars 2010<\/strong><\/p>","protected":false},"author":1,"featured_media":0,"template":"","categorie_communiques":[48],"syndicat":[78],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
