Februar 2009 kam es zu einiger Einigung betreffend den Sozialplan der Firma LUDEC s.\u00e0 r.l und ROTAREX Distribution was den Standort Holzem anbelangt.<\/p>\n<p>Da die Produktion um etwa 50% r\u00fcckl\u00e4ufig ist, und dies von der Direktion als eine langfristige bzw. definitive Entwicklung angesehen wird, wurden alle betroffenen Arbeitnehmer vom ersten Tag an und w\u00e4hrend der gesamten Verhandlungsdauer des Sozialplans mit sofortiger Wirkung freigestellt.<\/p>\n<p>Im Rahmen einer Personalversammlung mit Vertretern der ADEM wurden allen Betroffenen sowohl die Gr\u00fcnde dieses Sozialplans als auch die n\u00f6tigen Informationen und Schritte mitgeteilt.<\/p>\n<p>Nach der Personalversammlung wurde mit jedem Arbeitnehmer einzeln gesprochen. In jedem dieser Gespr\u00e4che waren der zust\u00e4ndige OGBLZentralsekret\u00e4r sowie der Betriebsrat anwesend.<\/p>\n<p>Den definitiv von diesem Sozialplan betroffenen Arbeitnehmern werden nochmals nach der Unterschrift in einzelnen Gespr\u00e4chen die K\u00fcndigungen mitgeteilt.<\/p>\n<p>1 Arbeitnehmer wurde seitens der Betriebsf\u00fchrung vom Sozialplan ausgenommen; 2 Arbeitnehmer haben die M\u00f6glichkeit, bei der Firma ROTAREX Group in Lintgen einen neuen Arbeitsplatz zu bekommen.<\/p>\n<p>F\u00fcr die qualifizierten Arbeitnehmer besteht jedoch Hoffnung auf eine schnelle Eingliederung in andere Betriebe.<\/p>\n<p>Nach sehr schwierigen Verhandlungen, die w\u00e4hrend der gesetzlich festgelegten Zeit von 14 Tagen abgeschlossen werden mussten gelang es, die Zahl der Personen, die zu diesem Zeitpunkt unter den Sozialplan fallen, von 30 auf \u201enur\u201e 29 zu reduzieren.<\/p>\n<p>Zu bemerken bleibt noch, dass 13 Arbeitnehmer eine Betriebszugeh\u00f6rigkeit von weniger als 5 Jahren haben und laut Gesetz keine Entsch\u00e4digungen bekommen.<\/p>\n<p>Zuz\u00fcglich zu den gesetzlichen Entsch\u00e4digungen wurden folgende Entsch\u00e4digungen ausgehandelt:<\/p>\n<ul>\n<li>3000 \u20ac\/Kind f\u00fcr denjenigen Arbeitnehmer der ein Kindergeldzertifikat nachweisen kann;<\/li>\n<li>250 \u20ac\/Jahr nach Alterszugeh\u00f6rigkeit;<\/li>\n<li>F\u00fcr jeden Arbeitnehmer eine zus\u00e4tzliche \u201esoziale Entsch\u00e4digung\u201c, wobei die Kriterien Kinder, Familienstand, Betriebszugeh\u00f6rigkeit, Alter ber\u00fccksichtigt wurden. Dieser Betrag wurde global verhandelt und die Verteilung vom Betriebsrat festgelegt.<\/li>\n<\/ul>\n<p><strong>Mitgeteilt vom Syndikat Metallverarbeitende Industrie und Garagen<\/strong><br \/>\n<strong>am 16.
