{"id":56089,"date":"2025-08-06T14:46:13","date_gmt":"2025-08-06T12:46:13","guid":{"rendered":"https:\/\/www.ogbl.lu\/?post_type=communiques&#038;p=56089"},"modified":"2025-08-06T14:47:44","modified_gmt":"2025-08-06T12:47:44","slug":"le-personnel-abandonne-la-direction-refuse-un-plan-social-equitable-malgre-des-profits-mondiaux-importants","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/de\/communique\/le-personnel-abandonne-la-direction-refuse-un-plan-social-equitable-malgre-des-profits-mondiaux-importants\/","title":{"rendered":"Le personnel abandonn\u00e9 \u2013 La direction refuse un plan social \u00e9quitable malgr\u00e9 des profits mondiaux importants"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-de\"> <\/p><p>La d\u00e9l\u00e9gation du personnel de Marks &amp; Clerk (Luxembourg) ainsi que l\u2019OGBL expriment leur vive inqui\u00e9tude et leur ferme opposition \u00e0 la d\u00e9cision de l\u2019entreprise de proc\u00e9der \u00e0 des licenciements massifs touchant 28 des 30 salari\u00e9s (ainsi qu\u2019un salari\u00e9 en contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e et un cadre sup\u00e9rieur qui ne sont pas concern\u00e9s par le plan social) \u2014 soit plus de 90 % des effectifs locaux.<\/p>\n<p>Ces licenciements, annonc\u00e9s sans consultation s\u00e9rieuse au pr\u00e9alable, font suite \u00e0 la d\u00e9cision interne de l\u2019entreprise de fermer son bureau luxembourgeois. Malgr\u00e9 les cons\u00e9quences majeures pour les salari\u00e9s et leurs familles, la direction de Marks &amp; Clerk LLP refuse \u00e0 ce jour de n\u00e9gocier un plan social juste et \u00e9quilibr\u00e9 avec la d\u00e9l\u00e9gation du personnel.<\/p>\n<p>Conform\u00e9ment au droit du travail luxembourgeois, un plan social doit \u00eatre n\u00e9goci\u00e9 dans un d\u00e9lai de 15 jours. Ce premier d\u00e9lai a expir\u00e9 le 22 juillet 2025, sans qu\u2019aucun progr\u00e8s significatif n\u2019ait \u00e9t\u00e9 r\u00e9alis\u00e9. Le dossier a donc \u00e9t\u00e9 transmis \u00e0 l\u2019Office national de conciliation (ONC), et une premi\u00e8re r\u00e9union a eu lieu le 4 ao\u00fbt 2025.<\/p>\n<p>Malgr\u00e9 cette escalade formelle, la direction de Marks &amp; Clerk LLP ne montre toujours aucune volont\u00e9 de modifier sa position ou de s&#8217;engager s\u00e9rieusement dans les n\u00e9gociations. Conform\u00e9ment \u00e0 la proc\u00e9dure, un nouveau d\u00e9lai de 15 jours a \u00e9t\u00e9 d\u00e9clench\u00e9. \u00c0 d\u00e9faut d\u2019accord d\u2019ici le 19 ao\u00fbt 2025, l\u2019employeur sera en droit de proc\u00e9der aux licenciements en appliquant uniquement les conditions l\u00e9gales minimales, sans n\u00e9gociation de plan social .<\/p>\n<p><strong>La d\u00e9l\u00e9gation du personnel, appuy\u00e9e par l\u2019OGBL, revendique les mesures sociales suivantes :<\/strong><\/p>\n<ul>\n<li>le recours \u00e0 une soci\u00e9t\u00e9 luxembourgeoise de \u00ab outplacement \u00bb<\/li>\n<li>un budget cons\u00e9quent pour la formation et la reconversion professionnelle<\/li>\n<li>des efforts concrets de reclassement interne des salari\u00e9s concern\u00e9s au sein du groupe<\/li>\n<li>des compensations financi\u00e8res extra-l\u00e9gales significatives, prenant en compte l\u2019anciennet\u00e9 et des crit\u00e8res sociaux<\/li>\n<\/ul>\n<p>Ces mesures sont essentielles, car les salari\u00e9s concern\u00e9s travaillent dans un secteur hautement sp\u00e9cialis\u00e9 \u2014 la propri\u00e9t\u00e9 intellectuelle \u2014 o\u00f9 les opportunit\u00e9s d\u2019emploi au Luxembourg sont tr\u00e8s limit\u00e9es.<\/p>\n<p>Cette situation est d\u2019autant plus pr\u00e9occupante que Marks &amp; Clerk est un cabinet de propri\u00e9t\u00e9 intellectuelle actif \u00e0 l\u2019\u00e9chelle mondiale, avec des bureaux en Europe, en Am\u00e9rique du Nord et en Asie. \u00c0 ce titre, Marks &amp; Clerk LLP (qui couvre les bureaux du Royaume-Uni et du Luxembourg) a r\u00e9alis\u00e9 un b\u00e9n\u00e9fice de 24 053 713 euros pour l\u2019exercice financier 2024 (avant r\u00e9mun\u00e9ration des associ\u00e9s) \u2014 ce qui repr\u00e9sente une augmentation de plus de 20\u202f% par rapport \u00e0 l\u2019exercice 2023. Le manque de responsabilit\u00e9 sociale envers les salari\u00e9s luxembourgeois est donc d\u2019autant plus injustifiable. Lors des discussions avec la direction, celle-ci a notamment d\u00e9clar\u00e9 que m\u00eame si les revendications sont abordables, cela ne signifie pas que l\u2019entreprise doive les accepter ou les financer \u2014 une position r\u00e9v\u00e9latrice de son refus de soutenir ses salari\u00e9s, malgr\u00e9 une capacit\u00e9 financi\u00e8re clairement suffisante.<\/p>\n<p><strong>La d\u00e9l\u00e9gation du personnel souligne :<\/strong><\/p>\n<ul>\n<li>l\u2019absence de v\u00e9ritable dialogue social<\/li>\n<li>le manque de transparence concernant la d\u00e9cision de fermeture et sa mise en \u0153uvre<\/li>\n<li>le refus d\u2019offrir une compensation appropri\u00e9e, un accompagnement professionnel ou des mesures de reclassement<\/li>\n<\/ul>\n<p><strong>Nous appelons la direction de Marks &amp; Clerk \u00e0 :<\/strong><\/p>\n<ul>\n<li>s\u2019engager sans d\u00e9lai dans des n\u00e9gociations constructives et sinc\u00e8res<\/li>\n<li>assumer sa responsabilit\u00e9 vis-\u00e0-vis des salari\u00e9s qui ont contribu\u00e9 de mani\u00e8re significative aux activit\u00e9s europ\u00e9ennes du groupe<\/li>\n<\/ul>\n<p>La d\u00e9l\u00e9gation du personnel, avec le soutien de l\u2019OGBL, reste pleinement engag\u00e9e en vue de d\u00e9fendre les droits et les int\u00e9r\u00eats des salari\u00e9s concern\u00e9s par tous les moyens juridiques et institutionnels disponibles.<\/p>\n<p><strong>Communiqu\u00e9 par le syndicat Services et Energie de l\u2019OGBL,<br \/>\n<\/strong><strong>le 6 ao\u00fbt 2025<\/strong><\/p>","protected":false},"author":4,"featured_media":56092,"template":"","categorie_communiques":[54],"syndicat":[73],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
