{"id":537,"date":"2008-06-11T09:46:59","date_gmt":"2008-06-11T07:46:59","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/non-a-la-regression-sociale"},"modified":"2023-05-31T10:58:02","modified_gmt":"2023-05-31T08:58:02","slug":"non-a-la-regression-sociale","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/de\/communique\/non-a-la-regression-sociale\/","title":{"rendered":"Non \u00e0 la r\u00e9gression sociale"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-de\"> <\/p><p>Apr\u00e8s des ann\u00e9es de blocage, la r\u00e9vision de la directive europ\u00e9enne sur le temps de travail et la nouvelle directive sur le droit des travailleurs int\u00e9rimaires viennent de se concr\u00e9tiser suite au compromis politique que le Conseil \u00ab Emploi et affaires sociales \u00bb de l\u2019Union europ\u00e9enne a pu trouver lors de sa r\u00e9union \u00e0 Luxembourg le 9 juin 2008.<\/p>\n<p>Alors que la Ministre slov\u00e8ne de l\u2019Emploi, Madame Marjeta Cotman, s\u2019est d\u00e9clar\u00e9e tr\u00e8s satisfaite de cet accord en pr\u00e9cisant qu\u2019il conjugue \u00e0 la fois \u00ab l\u2019\u00e9quilibre n\u00e9cessaire entre s\u00e9curit\u00e9 des travailleurs et flexibilit\u00e9 du march\u00e9 de l\u2019emploi \u00bb, les syndicats europ\u00e9ens ne peuvent que partiellement se r\u00e9jouir du r\u00e9sultat atteint.<\/p>\n<p>D\u2019une part, tout en sachant qu\u2019il n\u2019y a pas encore de publication officielle du compromis trouv\u00e9, les deux syndicats luxembourgeois CGT-L (OGBL\/FNCTTFEL) et le LCGB se f\u00e9licitent de l\u2019accord politique que le Conseil \u00ab Emploi et affaires sociales \u00bb a pu conclure au niveau de la directive sur les travailleurs int\u00e9rimaires.<\/p>\n<p>En effet, le texte propos\u00e9 pr\u00e9voit que les travailleurs int\u00e9rimaires profiteront d\u00e9sormais d\u00e8s le premier jour du m\u00eame traitement (horaire de travail, p\u00e9riodes de repos, cong\u00e9s, salaires, etc.) que les travailleurs permanents. Il est cependant regrettable qu\u2019en Grande-Bretagne ce principe de l\u2019\u00e9galit\u00e9 du traitement des travailleurs sera uniquement accord\u00e9 aux employ\u00e9s en poste depuis 12 semaines.<\/p>\n<p>D\u2019autre part, l\u2019accord politique trouv\u00e9 au niveau de la directive sur le temps de travail est insatisfaisant et inacceptable puisqu\u2019il met plut\u00f4t l\u2019accent sur la flexibilit\u00e9 que sur la protection de la s\u00e9curit\u00e9 et de la sant\u00e9 des travailleurs. Alors que le texte de compromis limite la dur\u00e9e de travail \u00e0 une moyenne de 48 heures par semaine, il pr\u00e9voit toujours la clause de non-participation (l\u2019\u00ab optout \u00bb) contre laquelle les syndicats europ\u00e9ens ont manifest\u00e9 \u00e0 maintes reprises leur opposition. Pour m\u00e9moire, il s\u2019agit ici d\u2019une option individuelle de travailler plus que 48 heures par semaine.<\/p>\n<p>La CGT-L (OGBL\/FNCTTFEL) et le LCGB revendiquent toujours que cette clause de non-participation soit d\u00e9finitivement exclue du texte de la directive. Ils ne peuvent pas se r\u00e9jouir du fait que la dur\u00e9e jusqu\u2019ici illimit\u00e9e en termes d\u2019heures de travail a \u00e9t\u00e9 plafonn\u00e9e \u00e0 60 ou 65 heures par semaine.<\/p>\n<p>En outre, la proposition actuelle pr\u00e9voit de ne plus comptabiliser les \u00ab p\u00e9riodes inactives \u00bb des temps de garde comme des heures de travail effectives ce qui est inacceptable pour les deux syndicats luxembourgeois.<\/p>\n<p>Pour ces raisons, la CGT-L (OGBL\/FNCTTFEL) et le LCGB sont d\u2019avis que la r\u00e9vision de la directive sur l\u2019am\u00e9nagement du temps ne doit pas \u00eatre adopt\u00e9e sous sa forme actuelle et demandent aux responsables politiques comp\u00e9tents et au parlement europ\u00e9en de tout faire pour que la possibilit\u00e9 de l\u2019\u00ab opt-out \u00bb soit d\u00e9finitivement abolie et que les propositions actuelles sur la r\u00e9vision du temps de garde soient revues.<\/p>\n<p><strong>Communiqu\u00e9 par le Secr\u00e9tariat europ\u00e9en commun de la CGT-L<\/strong><br \/>\n<strong>(OGBL\/FNCTTFEL) et du LCGB<\/strong><br \/>\n<strong>Luxembourg, le 11 juin 2008<\/strong><\/p>","protected":false},"author":1,"featured_media":0,"template":"","categorie_communiques":[38],"syndicat":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v23.1 -
