Les repr\u00e9sentants des salari\u00e9s ont attir\u00e9 l\u2019attention du ministre sur divers \u00e9l\u00e9ments du dossier, dont notamment:<\/p>\n<ul>\n<li>L\u2019excellente situation financi\u00e8re de l\u2019entreprise qui continue \u00e0 d\u00e9gager de substantiels b\u00e9n\u00e9fices tout en ayant tir\u00e9 d\u2019\u00e9normes avantages suite \u00e0 une pratique de \u00abruling fiscal\u00bb tr\u00e8s<b> <\/b>int\u00e9ressante.<\/li>\n<\/ul>\n<ul>\n<li>La direction refuse toute n\u00e9gociation concr\u00e8te et r\u00e9elle sur les \u00e9l\u00e9ments d\u2019un Plan de Maintien dans l\u2019Emploi en \u00abbalayant\u00bb tout simplement les propositions constructives de la d\u00e9l\u00e9gation et des syndicats. Pour rappel, la mise en place d\u2019un plan de maintien permettrait, dans ce cas concret, d\u2019\u00e9viter bon nombre de licenciements et donnerait \u00e9galement la possibilit\u00e9 de voir si la mise en place de la \u00abnouvelle strat\u00e9gie\u00bb donne les r\u00e9sultats escompt\u00e9s.<\/li>\n<\/ul>\n<ul>\n<li>Il est quasi impossible pour le c\u00f4t\u00e9 syndical de se faire une image concr\u00e8te de la nouvelle strat\u00e9gie que la direction souhaite mettre en place, car cette derni\u00e8re ne fournit quasiment pas d\u2019informations r\u00e9elles permettant de se faire une id\u00e9e<b> <\/b>globale.<\/li>\n<\/ul>\n<ul>\n<li>Les informations sont distill\u00e9es au compte-goutte et l\u2019attitude irresponsable de la direction fr\u00f4le en permanence la r\u00e9tention d\u2019informations et en plus elle se cache r\u00e9guli\u00e8rement derri\u00e8re le couvert de la confidentialit\u00e9 des informations. En tout cas, les repr\u00e9sentants des salari\u00e9s estiment ne pas avoir re\u00e7u les informations n\u00e9cessaires leur permettant de mener des n\u00e9gociations constructives.<\/li>\n<\/ul>\n<ul>\n<li>Finalement, l\u2019attitude ind\u00e9cente de la direction, entre autres en mati\u00e8re de mesures sociales d\u2019accompagnement des salari\u00e9s licenci\u00e9s, a d\u00e9finitivement fait d\u00e9border le vase et a oblig\u00e9 les repr\u00e9sentants des salari\u00e9s de constater l\u2019\u00e9chec des n\u00e9gociations et de saisir l\u2019Office National de Conciliation.<\/li>\n<\/ul>\n<ul>\n<li>Les repr\u00e9sentants des syndicats ont \u00e9galement signal\u00e9 au ministre que des choix politiques urgents s\u2019imposent et qu\u2019il faut rapidement adapter la l\u00e9gislation sur les licenciements collectifs et sur le licenciement \u00e9conomique en les rendant plus contraignants, voir impossibles pour les entreprises, qui comme John Zink sont largement b\u00e9n\u00e9ficiaires et qui ont des attitudes plus que douteuses<b> <\/b>par rapport au<b> <\/b>dialogue social tel que men\u00e9 et pratiqu\u00e9 au Luxembourg.<\/li>\n<\/ul>\n<p>Le ministre a \u00e9cout\u00e9 attentivement les explications des d\u00e9l\u00e9gu\u00e9s et a<b> <\/b>exprim\u00e9 son \u00e9tonnement et son incompr\u00e9hension face \u00e0 l\u2019attitude de la direction de l\u2019entreprise. Il a \u00e9galement pris note des dol\u00e9ances plus pr\u00e9cises concernant une adaptation rapide de la l\u00e9gislation.<\/p>\n<p>Tout en insistant sur le respect de l&#8217;esprit de la loi en mati\u00e8re de licenciement collectif il a relev\u00e9 l&#8217;importance du dialogue social dans l&#8217;entreprise afin de garantir un maximum d&#8217;emplois.
