Les n\u00e9gociations ont d\u00e9but\u00e9 et l\u2019OGBL ne peut que constater que cette situation est le seul r\u00e9sultat d\u2019une concurrence d\u00e9loyale qui s\u00e9vit dans le secteur.<\/p>\n<p>Depuis plus de deux ans, l\u2019OGBL d\u00e9nonce les pratiques d\u2019entreprises luxembourgeoises et \u00e9trang\u00e8res et de leurs sous-traitants qui ne respectent pas les conventions collectives et la l\u00e9gislation en vigueur. Les infractions portent sur les r\u00e9mun\u00e9rations, le temps de travail et les exigences en mati\u00e8re de s\u00e9curit\u00e9 et de sant\u00e9 des salari\u00e9s. Ces pratiques d\u2019esclavage moderne permettent \u00e0 ces entreprises d\u2019offrir des prix en dessous du prix de revient des entreprises qui elles respectent les lois et leurs salari\u00e9s.<\/p>\n<p>Le gouvernement doit agir pour sauver des postes de travail<\/p>\n<p>L\u2019OGBL engage directement la responsabilit\u00e9 du gouvernement et des administrations comp\u00e9tentes qui bien que connaissant la situation n\u2019ont \u00e0 ce jour rien fait pour y mettre fin. Il est intol\u00e9rable qu\u2019une entreprise luxembourgeoise, comme Ferrac S\u00e0rl, qui respecte ses salari\u00e9s, les lois, les salaires conventionnels et le dialogue social, soit contrainte de licencier une partie de son personnel. Ceci non pas par manque de travail dans le secteur, mais seulement parce qu\u2019elle ne peut pas se battre avec les m\u00eames armes que les concurrents d\u00e9loyaux.<\/p>\n<p>L\u2019OGBL exige une r\u00e9ponse rapide du gouvernement pour permettre \u00e0 l\u2019entreprise Ferrac S\u00e0rl de sauver le plus d\u2019emplois possibles. L\u2019OGBL a salu\u00e9 l\u2019introduction du badge social depuis le 1er septembre, mais cette seule mesure n\u2019est pas suffisante pour \u00e9radiquer les pratiques de concurrence d\u00e9loyale et d\u2019esclavage moderne qui mettent en p\u00e9ril tous les secteurs de la construction et de l\u2019artisanat du b\u00e2timent. Des moyens r\u00e9pressifs efficaces doivent \u00eatre mis en place sous forme d\u2019amendes (inexistantes \u00e0 ce jour), de m\u00eame que la possibilit\u00e9 pour les organes de contr\u00f4le de fermer les chantiers hors-la-loi. Il en va de la survie des emplois et des entreprises.<\/p>\n<p>Responsabilit\u00e9 sociale des entreprises et de l\u2019\u00c9tat<\/p>\n<p>L\u2019OGBL d\u00e9nonce \u00e9galement les entreprises et les donneurs d\u2019ordre qui, en toute connaissance de cause, font appel \u00e0 ces entreprises en ne tenant compte que du seul crit\u00e8re du prix. Le donneur d\u2019ordre qui recourt \u00e0 la sous-traitance doit \u00eatre responsable des conditions de travail et de r\u00e9mun\u00e9ration du personnel de ses sous-traitants si ces derniers ne respectent pas la loi. Au-del\u00e0 de limiter les abus, ce syst\u00e8me m\u00e8nerait \u00e9galement \u00e0 une am\u00e9lioration des conditions de travail et de la s\u00e9curit\u00e9 sur les chantiers.<\/p>\n<p>N\u2019oublions pas que l\u2019\u00c9tat fait partie de ces donneurs d\u2019ordre puisque, de par sa politique de soumissions, il entraine un cannibalisme entre les diff\u00e9rentes entreprises qui se fait aux d\u00e9pens de la s\u00e9curit\u00e9, de la sant\u00e9 et du bien-\u00eatre des salari\u00e9s. Nous exigeons que le seul crit\u00e8re du prix le plus bas soit abandonn\u00e9.
