Juni 2013 hat der Europ\u00e4ische Gerichtshof die luxemburgische Regierung und ihren ehemaligen Minister Fran\u00e7ois Biltgen schwer gedem\u00fctigt. Laut EuGH geht die luxemburgische Regelung zur staatlichen Studienbeihilfe \u00fcber das hinaus, was zur Erreichung des von der Regierung verfolgten Ziels notwendig ist, d.\u00a0h. die F\u00f6rderung der Hochschulausbildung und die wesentliche Erh\u00f6hung der Anzahl der in Luxemburg ans\u00e4ssigen Personen mit Hochschulabschluss.<\/p>\n<p>Tats\u00e4chlich verhindert das Wohnsitzerfordernis im Gesetz \u00fcber die Studienbeihilfe nach Ansicht des Gerichtshofs die Ber\u00fccksichtigung anderer potenziell repr\u00e4sentativer Elemente f\u00fcr den tats\u00e4chlichen Grad der Verbundenheit des Antragstellers mit der luxemburgischen Gesellschaft oder dem luxemburgischen Arbeitsmarkt, wie etwa den Umstand, dass ein Elternteil, der f\u00fcr den Studierenden weiter unterhaltspflichtig ist, ein Grenzg\u00e4nger ist, der in Luxemburg dauerhaft einer T\u00e4tigkeit nachgeht, und das bereits seit geraumer Zeit.<\/p>\n<p>Die luxemburgische Regierung ist nun aufgerufen, das betreffende Gesetz zu \u00e4ndern, um den Kindern der Grenzg\u00e4nger die finanzielle Beihilfe zu gew\u00e4hren. Dies gilt nicht nur k\u00fcnftig sondern auch r\u00fcckwirkend ab dem Zeitpunkt, zu dem ihre Antr\u00e4ge auf Beihilfe von der Regierung zu Unrecht abgelehnt worden waren. Die betroffenen Studenten k\u00f6nnen gegebenenfalls eine Zivilklage wegen Versto\u00dfes gegen das Gemeinschaftsrecht anstrengen.<\/p>\n<p>Das Urteil des Gerichtshofes erfolgt im Anschluss an ein Ersuchen um Vorabentscheidung vonseiten des Verwaltungsgerichts, das nun seinerseits das Problem durch Umsetzung der im Urteil genannten Anweisungen bew\u00e4ltigen muss. Das Urteil kann jedoch erst in ein paar Monaten im Anschluss an neue Verhandlungen vor dem Verwaltungsgericht in Kraft treten.<\/p>\n<p>&nbsp;<\/p>\n<p>Der OGBL ist der Meinung, dass unser Land diese Dem\u00fctigung h\u00e4tte verhindern k\u00f6nnen. Es ist bedauernswert, dass die Regierung den wiederholten Forderungen des OGBL hinsichtlich der Suche nach einer politischen L\u00f6sung dieses Problems zur Verhinderung des von Beginn an absehbaren juristischen Fiaskos kein Geh\u00f6r geschenkt hat.<\/p>\n<p>Tats\u00e4chlich wies der OGBL nach der Verabschiedung des Gesetzes im Juli 2010 die Regierung und die Europ\u00e4ische Kommission als erste Organisation auf dessen diskriminierende Natur gegen\u00fcber den Kindern der Grenzg\u00e4nger hin. Und als die ersten Rechtsmittel eingelegt wurden, forderte der OGBL die Regierung zur \u00c4nderung des Gesetzes auf. Denn es ist unvorstellbar, dass in einem Land der Europ\u00e4ischen Union das Gemeinschaftsrecht, insbesondere im Hinblick auf soziale Leistungen und Vorteile, nicht f\u00fcr alle Arbeitnehmer gilt, ob nun gebietsans\u00e4ssig oder nicht.<\/p>\n<p><strong>Mitgeteilt vom OGBL<br \/>\nam 20.
