{"id":1284,"date":"2012-10-22T14:31:15","date_gmt":"2012-10-22T12:31:15","guid":{"rendered":"https:\/\/www.ogbl.lu\/communiques\/plan-social-signe-2"},"modified":"2023-06-02T13:41:16","modified_gmt":"2023-06-02T11:41:16","slug":"plan-social-signe-2","status":"publish","type":"communiques","link":"https:\/\/www.ogbl.lu\/de\/communique\/plan-social-signe-2\/","title":{"rendered":"Plan social sign\u00e9"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-de\"> <\/p><p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-10375\" title=\"hyosung\" src=\"https:\/\/www.ogbl.lu\/wp-content\/uploads\/communiques\/hyosung.jpg\" alt=\"\" width=\"248\" height=\"150\" \/>Ce lundi 22 octobre, la direction de la soci\u00e9t\u00e9 Hyosung Wire Luxembourg S.A. et les repr\u00e9sentants du personnel dont les syndicats OGBL et LCGB ont sign\u00e9 un plan social pour les quelque 200 salari\u00e9s de l\u2019usine de Roost qui prendra effet le 1er d\u00e9cembre 2012. 14 salari\u00e9s continueront \u00e0 travailler pour l\u2019entreprise en reclassement interne dans les domaines de stockage et de vente. Par ailleurs, 23 salari\u00e9s pourront b\u00e9n\u00e9ficier de la pr\u00e9retraite-ajustement ou de la retraite anticip\u00e9e. Les d\u00e9l\u00e9gu\u00e9s du personnel resteront sous contrat avec l\u2019entreprise jusqu\u2019\u00e0 la fin du plan social, \u00e0 savoir le 31 d\u00e9cembre 2014.<\/p>\n<p>L\u2019OGBL regrette que Hyosung ait pris la d\u00e9cision d\u2019arr\u00eater son activit\u00e9 de production de \u00absteelcord\u00bb au Luxembourg plut\u00f4t que d\u2019investir dans l\u2019\u00e9quipement de production. Il est incompr\u00e9hensible, et, du point de vue \u00e9cologique, totalement insens\u00e9, de faire d\u00e9sormais venir ce produit du Vietnam pour honorer le contrat entre Hyosung et Good Year alors que les deux usines se trouvent \u00e0 quelques pas l\u2019une de l\u2019autre.<\/p>\n<p>Le plan social s\u2019applique aux salari\u00e9s li\u00e9s par un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9. Sont donc exclus les salari\u00e9s engag\u00e9s sous contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e ainsi que les salari\u00e9s en p\u00e9riode d\u2019essai.<\/p>\n<p>Les salari\u00e9s licenci\u00e9s b\u00e9n\u00e9ficieront d\u2019un d\u00e9lai de pr\u00e9avis en fonction de leur anciennet\u00e9 conform\u00e9ment au Code du travail. Les d\u00e9lais de pr\u00e9avis commenceront \u00e0 courir le 1er d\u00e9cembre 2012.<\/p>\n<p>Les salari\u00e9s continueront \u00e0 travailler pendant la p\u00e9riode de pr\u00e9avis jusqu\u2019\u00e0 l\u2019arr\u00eat complet de l\u2019activit\u00e9 de production, \u00e0 savoir le 1er avril 2013. Les salari\u00e9s dont le pr\u00e9avis continuerait \u00e0 courir apr\u00e8s cette date seront dispens\u00e9s de travailler.<\/p>\n<p>Les indemnit\u00e9s de d\u00e9part pr\u00e9vues par la loi seront vers\u00e9es \u00e0 chaque salari\u00e9 concern\u00e9 au moment de sa sortie effective du personnel et au plus tard \u00e0 l\u2019expiration du d\u00e9lai de pr\u00e9avis l\u00e9gal.<br \/>\n<strong><br \/>\nIndemnit\u00e9 extra-l\u00e9gale de 100 euros<\/strong><\/p>\n<p>Outre l\u2019indemnit\u00e9 de d\u00e9part l\u00e9gale, l\u2019employeur versera \u00e0 chaque salari\u00e9 licenci\u00e9 une indemnit\u00e9 de d\u00e9part extra-l\u00e9gale correspondant \u00e0 100 euros par mois d\u2019anciennet\u00e9.<\/p>\n<p>Toutefois le versement de cette indemnit\u00e9 est conditionn\u00e9. Si le salari\u00e9 est absent pour cause de maladie entre 1 et 9 jours de travail pendant le mois de pr\u00e9avis devant effectivement \u00eatre prest\u00e9, le montant de l\u2019indemnit\u00e9 sera r\u00e9duit de 500 euros. Et si le salari\u00e9 est absent pendant plus de 9 jours pendant un mois de pr\u00e9avis, l\u2019indemnit\u00e9 sera diminu\u00e9e de 1000 euros.<\/p>\n<p>Les salari\u00e9s qui n\u2019auront pas \u00e9t\u00e9 absents du travail pendant la p\u00e9riode de pr\u00e9avis devant \u00eatre effectivement prest\u00e9e recevront une prime unique d\u2019un montant de 500 euros.<\/p>\n<p>Enfin, tous les salari\u00e9s qui remplissent au cours des ann\u00e9es 2013 et 2014 les conditions pour l\u2019octroi de la pr\u00e9retraite-ajustement pourront faire valoir ce droit selon les dispositions l\u00e9gales en vigueur. Les salari\u00e9s qui accepteront de b\u00e9n\u00e9ficier d\u2019une mesure de pr\u00e9retraite-ajustement au cours des ann\u00e9es en question recevront de la part de l\u2019employeur une somme correspondant \u00e0 2 mois de salaire brut.
